OKAY. EVERYONE, WELCOME TO MATIAS COURT. IF YOU PLEASE RISE, WE'LL HAVE THE PLEDGES. I
[1. Call meeting to order]
PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA. AND TO THE REPUBLIC FOR WHICH IT STANDS. ONE NATION UNDER GOD, INDIVISIBLE, WITH LIBERTY AND JUSTICE FOR ALL. HONOR THE TEXAS FLAG. I PLEDGE ALLEGIANCE TO THEE. TEXAS. ONE STATE UNDER GOD, ONE AND INDIVISIBLE. OKAY.[3. Citizens to be heard]
THANK YOU. AND AGAIN, GOOD MORNING. WE'LL GO AHEAD AND PROCEED TO CITIZENS TO BE HEARD.I DO HAVE ONE CARD THIS MORNING FROM SONYA WEATHERSPOON. MISS WEATHERSPOON, IF YOU'LL COME TO THE MICROPHONE, PLEASE. MY NAME IS SONYA WITHERSPOON. AND I LIVE AT 13830 COUNTY ROAD 1694, IN ODUM. I'M VERY OBSERVANT AND NOTICED WHEN HIS WIFE ATTENDED COMMISSIONERS COURT WITH HIM ON NOVEMBER 4TH, THAT COMMISSIONER YARDLEY HAS BEEN DRIVING A WHITE TRUCK INSTEAD OF HIS MAROON ONE. WHEN THE COUNTY AUDITOR COMMENTED LAST WEEK THAT THE INSURANCE LIABILITY COST INCREASED DUE TO SOME PUBLIC OFFICIALS RECENT LIABILITY CLAIMS. I REQUESTED AND OBTAINED RECORDS FROM SAN PATRICIO COUNTY AND REFUGIO COUNTY. I ADMIT IT DOES NOT LOOK GOOD THAT COMMISSIONER YARDLEY DID NOT FOLLOW PROCEDURE IN THE EMPLOYEE HANDBOOK, AND THE COUNTY HAS YET TO RELEASE IF OR WHEN HE TOOK THE REQUIRED DRUG TEST AFTER THE ACCIDENT.
COMMISSIONER YARDLEY DIDN'T REPORT TO IT TO THE NEW EMERGENCY MANAGEMENT COORDINATOR EITHER, AND PROCEEDED TO TAKE HIS DAMAGED VEHICLE. VEHICLE OUTSIDE OF SAN PATRICIO COUNTY FOR THE REPAIRS. EVEN MORE CONCERNING ARE THE DISCREPANCIES BETWEEN THE DOCUMENTS I OBTAINED FROM REFUGIO COUNTY AND THE GOVERNMENT DOCUMENTS. COMMISSIONER YARDLEY PREPARED AND SUBMITTED TO OUR COUNTY FOR TACK. HE TYPED THE DATE OF THE INCIDENT AS 11 ONE, 2024 AND STATED A SEMI TRUCK FORCED HIM INTO THE GUARDRAIL. ON THE FOURTH, HE REPORTED HE ATTENDED A CONFERENCE AND THEN THE AGENDA SHOWS THAT IT ENDED AT NOON ON THURSDAY THE 31ST. IF THE ACCIDENT HAPPENED ON THE FIRST, WHY WAS HE TRAVELING OUTSIDE OF OUR COUNTY AND HIS COUNTY VEHICLE ON THE DAY? AND WHY DOES THE DEPUTY'S REPORT NOT MATCH HIS STATEMENT? IF THE ACCIDENT DID HAPPEN AROUND 3:46 P.M. ON THE 31ST, WHY DID COMMISSIONER YARDLEY TAMPER WITH AND FALSIFY HIS GOVERNMENT RECORD? IT WASN'T AN ERROR OR TYPO ON HIS REPORT, BECAUSE THE EMAIL HE SENT TO THE WRONG EMPLOYEE EVEN SAID ATTACHED IS THE TACK ACCIDENT FORM FOR MY ACCIDENT LAST FRIDAY. FURTHERMORE, THE CRASH REPORT SHOWS THE CONTRIBUTING FACTORS AS DRIVER INATTENTION AND FAULTY EVASIVE ACTION FURTHER EXPLAINED IN MY POWERPOINT WITH NO MENTION OF A SEMI TRUCK. RECENTLY, I MET WITH THE DISTRICT ATTORNEY'S INVESTIGATOR, BEGAN A CASE FOR INVESTIGATION WITH THE SHERIFF'S OFFICE, AND PREPARING SEVERAL SWORN COMPLAINTS WITH THE TEXAS ETHICS COMMISSION ABOUT CAMPAIGN FINANCE REPORTS, AND CONTACTED THE TEXAS ASSOCIATION OF COUNTIES TO FIND OUT WHO HAS JURISDICTION. FOR MY OFFICIAL COMPLAINTS ABOUT THE ILLEGAL MOU WITH PRIVATE ENTITIES, BRIBERY AND ABUSE OF OFFICE BY COMMISSIONER LOPEZ, AS WELL AS COMMISSIONER WILKINSON'S ONGOING ILLEGAL MISUSE OF GOVERNMENT PROPERTY, SOLICITATION AND ACCEPTANCE OF GIFTS, ABUSE OF OFFICE AND ILLEGALLY USING AN EMPLOYEE FOR HER CAMPAIGN TREASURER. AND NOW THIS ILLEGAL INSURANCE FRAUD AND FALSIFICATION OF GOVERNMENT RECORDS BY COMMISSIONER YARDLEY. THIS OFFENSE OF INSURANCE FRAUD IS PUNISHABLE AS A STATE JAIL FELONY OR FELONY OF THE THIRD DEGREE, DEPENDING ON THE COST TO REPAIR THE DAMAGE TO HIS COUNTY VEHICLE, AND TAMPERING WITH AND FALSIFYING GOVERNMENT RECORDS IS EITHER A CLASS B MISDEMEANOR OR A STATE JAIL FELONY. BOTH ARE GROUNDS FOR COMMISSIONER YARDLEY TO REMOVE FROM PUBLIC OFFICE FOR OFFICIAL MISCONDUCT. AND YET, MY HUSBAND AND I AND BARBARA LOPEZ ARE THE ONES THAT HAVE HAD OUR CHARACTER PUBLICLY DEFAMED BOTH INSIDE AND OUTSIDE OF THIS COURT. THANK YOU ONCE AGAIN FOR YOUR TIME. THANK YOU. AND GO STAND AGAINST A WALL OVER THERE, GUYS. Y'ALL USED TO STAND IN FRONT FOOTBALL DURING FOOTBALL GAMES ANYWAY, SO I DON'T KNOW WHY YOU'RE SITTING THIS MORNING.
GO MAROON AND WHITE. NOW. THIS IS AWESOME. YEAH. WAY TO GO, MICHAEL. OKAY, COACHES, Y'ALL DON'T NEED TO HIDE BACK HERE IN THE ENTRYWAY NOW. COME ON UP HERE AND JOIN THEM. IS ALL THE REASON WHY THEY'RE SO SUCCESSFUL. SO, YEAH. THIS IS AWESOME. CONGRATULATIONS. OKAY,
[a. Recognition and Congratulations by Commissioner R&B #1 Sonia Lopez and the Court goes out to the Sinton Pirate Football team for bringing home the 2024 Regional Semifinals Champs Victory. You've had an amazing year, and we are all so proud of you. Go Pirates!]
WE WILL GO AHEAD AND MOVE ON DOWN TO ITEM 2.4 A ON THE AGENDA. SINCE I KNOW THEY'RE READY TO GO BACK TO GET INTO ATHLETIC CLASS AND REALLY WORK OUT SOME MORE. SO RECOGNITION[00:05:02]
AND CONGRATULATIONS BY ROAD AND BRIDGE COMMISSIONER NUMBER ONE SONIA LOPEZ. AND THE COURT GOES OUT TO THE SINTON PIRATES FOOTBALL TEAM FOR BRINGING HOME THE 2024. BRINGING HOME THE 2024 REGIONAL SEMIFINAL CHAMP VICTORY. YOU'VE HAD AN AMAZING YEAR AND WE WERE SO PROUD OF YOU. SO GO PIRATES! COMMISSIONER SHOW. YES, I JUST WANTED TO SHOW MY PIRATE PRIDE FOR THE LOVE OF SINTON. AND I'D LIKE FOR THE COACHES TO COME AND SPEAK A LITTLE BIT ABOUT ABOUT THIS GROUP OF YOUNG MEN WHO PULLED TOGETHER AND WENT AS FAR AS THEY DID, AND. COACH TROUTMAN. WE WANT TO WE WANT TO THANK YOU ALL FOR THIS OPPORTUNITY. BUT THIS IS A THIS WAS A VERY SPECIAL GROUP OF YOUNG MEN HERE. AND, YOU KNOW, COMING OFF OF LAST YEAR'S DEFEAT IN THE REGIONAL FINAL STATE QUARTERFINALS GAME, THEY HAD A GOAL. THEY HAD A GOAL. AND WALKING OUT OF THAT LOCKER ROOM LAST YEAR, A LOT OF THEM LOOKED ME IN THE EYE AND SAID, WE'RE GOING TO BE BACK, COACH. WE'RE GOING TO BE BACK IN. AND THAT WAS THE YEAR OF REALIGNMENT. AND SO GOING INTO THIS SOME YEAR, WE HAD TO REDO OUR WHOLE FOOTBALL SCHEDULE IN THE CHALLENGING PART WAS, IS THAT, YOU KNOW, I USE AN ANALOGY LAST YEAR, THIS THE BEGINNING OF THIS YEAR THAT YOU EVER PLAYED THAT GAME WHERE YOU, YOU FALL BACK AND YOU TRUST THAT SOMEBODY BACK THERE AND YOU AND YOU REALLY YOU GOT TO TRUST THAT THAT I WAS GOING TO PUT THIS SCHEDULE TOGETHER AND THESE GUYS WERE GOING TO HANDLE BUSINESS AND TAKE CARE OF IT. AND THERE'S NO DOUBT ABOUT IT THAT THIS TEAM RIGHT HERE WENT THROUGH THE GRIND OF ONE OF THE HARDEST SCHEDULES THERE WAS IN THE STATE OF TEXAS, PLAYING THE LIKES OF GREGORY-PORTLAND, CALALLEN, CORPUS CHRISTI MILLER, ALICE, PORT LAVACA. BEEVILLE, AND THEY THEY CAME OUT WITH AN UNDEFEATED PRESEASON SCHEDULE. AND THAT IS A TESTAMENT TO THEM NOT BACKING DOWN FROM NO. ONE. AND THAT'S WHAT BEING A PIRATE IS ALL ABOUT. THAT'S WHAT IT'S ALL ABOUT. AND THEY'RE VERY EASILY COULD HAVE, COULD HAVE, SAID, COACH, WE'RE PLAYING THE BEST IN THE COASTAL BEND, AND THEY COULD HAVE WALKED AWAY AND THEY COULD HAVE PUT THEIR HEADS DOWN, BUT INSTEAD THEY CHOSE TO FIGHT EVERY WEEK. EVERY WEEK THEY CHOSE TO FIGHT. AND THAT'S ABOUT CHARACTER. THAT'S ABOUT INTEGRITY. THAT'S ABOUT WHO THEY ARE AS SITTING PIRATES. AND SO THEY AND SO THEY WENT THROUGH THE PRESEASON UNDEFEATED. AND THEY HAVE A GOAL EVERY YEAR. AND THAT GOAL IS TO BE THE DISTRICT CHAMPION. AND THAT GOAL IS TO MAKE A TO GET INTO THE PLAYOFFS AND MAKE A DEEP RUN IN THAT FIRST DISTRICT GAME. AND WE FACED ADVERSITY AND WE HAD INJURIES AND THE UPS AND DOWNS OF A SEASON. BUT THEY ALWAYS GOT UP AND KEPT MOVING ON. AND THAT LAST THAT FIRST DISTRICT GAME WAS AGAINST CORAL. AND WE KNEW THAT THE DISTRICT CHAMPIONSHIP WAS GOING TO COME BETWEEN US OR THEM. AND IF YOU IF YOU PAY ATTENTION TO THE SEASON, THERE WERE SEVERAL TIMES THAT WE GOT DOWN THE FIRST HALF, BUT THEY FOUND A WAY TO FIGHT BACK IN THAT SECOND HALF. AND THAT'S WHAT AND THAT'S WHAT IT'S ABOUT.AND THEY FOUGHT THAT SECOND HALF AND WE GOT DOWN AGAINST CORAL. THEY FOUGHT THEY FOUGHT THROUGH THAT SECOND HALF. THEY ENDED UP GETTING THE WIN OVER CORAL. AND THEY END UP TAKING CARE OF DISTRICT AND BEING UNDEFEATED. AND YOU KNOW, THAT IS THE THAT IS THE FIFTH THE FIFTH CONSECUTIVE DISTRICT CHAMPIONSHIP THAT THESE BOYS HAVE EARNED AS A SITTING PIRATE FIVE YEARS IN A ROW. AND NOW THEY'RE SECOND PART OF THE SEAT, THE THIRD PART OF THE SEASON, FIRST PART BEING THE PRESEASON, SECOND PART BEING DISTRICT AND THE THIRD PART BEING THE PLAYOFFS. NOW THEY HAD A NEW CHALLENGE AHEAD OF THEM, AND THAT WAS TO GET BACK WHERE WE WERE LAST YEAR, AND WE HAD SOME INJURIES WE HAD TO OVERCOME AND. EXTREMELY PROUD OF THESE BOYS.
FOR WHAT THEY DID. BECAUSE THEY FOUGHT THEIR BUTTS OFF, THEY FOUGHT THEIR BUTTS OFF, AND THEY FOUGHT THROUGH EVERY PLAYOFF GAME, EVEN WHEN THE ODDS WERE STACKED AGAINST THEM AND THEY STAYED TOGETHER. AND I THINK THAT ONE OF THE MOST ONE OF THE HIGHLIGHTS OF THE YEAR IS HOW CLOSE THIS GROUP WAS. AND IT WAS SPECIAL TO ME AS A COACH, BECAUSE WHEN I CAME IN IN 2019, THIS GROUP WAS WAS SEVENTH GRADERS. THERE WERE SEVENTH GRADERS. WE KNEW THIS WAS THE GROUP THAT WE WERE GOING TO BUILD IT WITH AS SEVENTH GRADERS, AND THEY WENT THROUGH THE WHOLE PROGRAM AND THEY FOUGHT THROUGH IT AND, AND, YOU KNOW, AND WE WON ALL THE PLAYOFF GAMES. AND WE GOT TO WIMBERLEY. AND UNFORTUNATELY WE CAME OUT ON THE SHORT END OF THE STICK. BUT I TELL YOU WHAT, THE FIGHT THAT THEY DISPLAYED TWO FRIDAY NIGHTS AGO, THAT SPEAKS VOLUMES ABOUT
[00:10:05]
WHAT TYPE OF MEN THEY ARE AND WHAT TYPE OF FIGHT THEY HAVE, AND THEY'RE GOING TO CARRY THAT FIGHT INTO THEIR LIVES BECAUSE THEY KNOW THEY'RE GOING TO GET KNOCKED DOWN IN LIFE AS A HUSBAND, AS A FATHER, BUT AS A PIE, THEY'RE GOING TO GET UP AND THEY'RE GOING TO KEEP MOVING FORWARD. AND THEY DISPLAYED THAT IN THAT GAME LAST TWO FRIDAY NIGHTS AGO, BECAUSE THEY VERY EASILY COULD HAVE WALKED INTO THAT HALFTIME WHEN WE WERE GETTING BEAT 29 TO 12 AND LAID THERE LATE, LAID THEIR HEADS DOWN, BUT THEY FOUGHT ALL THE WAY THROUGH. THEY FOUGHT ALL THE WAY THROUGH. WE JUST DIDN'T HAVE ENOUGH TIME ON THE CLOCK. I'M PROUD OF THIS GROUP. I'M PROUD OF THIS COACHING STAFF THAT WE HAVE AT PIRATE NATION THAT SIT IN HIGH SCHOOL AND SIT IN MIDDLE SCHOOL. THEY BELIEVE IN WHAT WE DO. THEY BELIEVE IN THE MAROON AND WHITE. THERE'S NO OTHER PLACE TO BE THAN SITTING. NO OTHER FIGHT THAN A SITTING PIRATE. THIS IS WHAT YOU GOT RIGHT HERE. GIVE ME A ROUND OF APPLAUSE. THESE 2024 STATE QUARTERFINALISTS, SITTING PIRATES AND DISTRICT CHAMPS. MICHAEL, LET ME JUST SAY FOR YOU THAT DON'T KNOW. THESE GUYS STARTED IN STATE, BUT THIS STARTED YEARS AGO WHEN MICHAEL WAS IN HIGH SCHOOL. MY BOYS AND HIM, ALONG WITH SEVERAL OTHERS WENT TO STATE. WE MADE IT TO WHAT, SEMIFINALS? YEAH, AND WE LOST BY ONE POINT. AND MICHAEL, DO YOU REMEMBER WHY? YEAH. WE. WE THE FIELD GOAL FOR THE WIN BOUNCED OFF THE UPRIGHT. YES. BUT THIS IT STARTED WITH ANOTHER COACH THAT HAD THE SAME VISION THAT THIS MAN HAS THAT WANTED TO INSTILL CHAMPIONSHIP AND SUCCESS IN THE LIVES OF HIS STUDENTS.AND THAT'S WHAT YOU HAVE IN THESE MEN AND COACH TROUTMAN. MY HAT'S OFF TO YOU GUYS. ADRIAN, WOULD YOU LIKE TO SAY SOMETHING? ALL RIGHT. I DON'T KNOW. THAT'S EXACTLY. IT'S HARD TO FOLLOW HIM, RIGHT? I'LL TELL YOU WHAT, MICHAEL. YOU'RE AN INCREDIBLE SPEAKER. I'M READY TO SIGN UP FOR THE MILITARY. MY GOSH. YEAH, COACH. THANK YOU. THANK YOU. YOU MADE SOUTH TEXAS VERY, VERY PROUD. I DIDN'T MAKE, YOU KNOW. AND THE BOYS, WELL, Y'ALL ARE PART OF IT. YOU YOU HELP THEM.
AND I'VE BEEN AMAZED AT WHEN I'VE BEEN ABLE TO GO OVER TO SINTON HIGH SCHOOL AND SEE THESE ATHLETES IN THE GYM WHEN THEY COME IN WEIGHT ROOM, HOW PROFESSIONAL THEY ACT. AND THAT'S BECAUSE OF THE INSPIRATION THAT YOU PUT INTO THEM. I WAS COACHED IN HIGH SCHOOL BY THE GENTLEMEN. Y'ALL ALL WELL KNOW. I'VE HEARD THE NAME RAY AKINS AT GREGORY-PORTLAND, AND HE DRILLED THAT INTO US. YOU ACT LIKE PROFESSIONALS, YOU BE PROFESSIONALS, YOU ACT LIKE MEN. BECAUSE WHEN YOU GO ON IN FURTHER IN LIFE, YOU'LL REALIZE THAT WHAT YOU LEARNED HERE IN HIGH SCHOOL AND AN ATHLETE, HOW SUCCESSFUL YOU WILL BECOME IN LIFE BECAUSE OF WHAT YOU LEARNED AND STUFF. YOU KNOW, WHEN PRESEASON STARTED, YOU KNOW, WE WATCHED CHANNEL THREE TO SEE WHO THE TOP TEAMS ARE. Y'ALL STARTED OUT, STARTED DOWN TOWARD THE BOTTOM. THEY KEPT CARPETS, KEPT WANTING TO PUT MILLER ON TOP, MILLER ON TOP UNTIL Y'ALL PLAYED THEM AND BEAT THEM. Y'ALL CAME OVER TO GREGORY-PORTLAND. I WAS IN THE STANDS THAT NIGHT WHEN Y'ALL WALKED ON THE FIELD AFTER THE FIRST SERIES OF. AFTER THE FIRST SERIES, I KNEW GREGORY-PORTLAND WAS IN FOR SOME SERIOUS TROUBLE BECAUSE Y'ALL SHOWED WHAT Y'ALL ARE AS A FOOTBALL TEAM. AND WHEN Y'ALL WALKED OFF THAT FIELD VICTORIOUS THAT NIGHT, I REALLY FELT PROUD BECAUSE I DO MY WORK UP HERE IN SINTON DURING THE DAY. I FEEL LIKE I'M PART OF YOU. I'M HALF GREGORY-PORTLAND, HALF SINTON, BUT Y'ALL WERE AN EXCEPTIONAL FOOTBALL TEAM THAT NIGHT, AND YOU SHOWED IT THE REST OF THE SEASON BECAUSE OF THE MEN THAT YOU ARE. SO KEEP IT UP. DON'T GIVE UP IN LIFE. BECAUSE IF YOU GIVE UP IN LIFE, IT'S NOT GOING TO BE FUN. KEEP UP. YOU WILL BE GREAT PEOPLE WHEN YOU GROW UP. GO TO COLLEGE AND GET YOU SOME STUDIES. GET YOUR DEGREE AND BECOME THE PERSON THAT COACHES INSPIRED YOU TO BECOME. SO COACH, THANK YOU FOR DOING THIS WITH THESE YOUNG MEN. YES, SIR. THANK YOU ALL. DO YOU THINK WE CAN DO IT? SURE. YOU GUYS WANT TO GET BACK TO TALK? HERE WE GO. HERE ARE SHORT ONES IN THE FRONT. OH, HEY, Y'ALL! QUICK! HE HAS FIVE. NORMAL. NORMA. NORMA. I COULD BE TALL ENOUGH. I THINK I'M GONNA HAVE TO STAND ON MY CHAIR. YOU CAN TAKE A PICTURE. LET'S GET YOU IN. SOME OF YOU GUYS SHOULD BE DOWN FRONT. I
[00:15:12]
GOTTA GO STAND BY THE SHOOTER. THERE YOU GO. THANK YOU. THAT'S MY. MAN. I GOT SOME FOR YOU, JESSE. WE'LL TALK AFTERWARDS. Y'ALL CAN SCOOT UP AND GET UP HERE IN A. TAKE A KNEE, PUSH MY TEAM OUT OF THE WAY. YOU SEE MY TO SAY, GET ON ME. OH, WE'RE. WHERE YOU WANT ME. ARE YOU ALRIGHT? I LIKE, MY. TO MY MIC. MIC CHECK. HEY, JORDAN. WE HAVE TO DO THIS ALL THE TIME. HEY.I'M HERE. THEY CAN'T SEE YOU, HOLLY. ALRIGHT. THAT'S MY BUDDY. WHAT DO YOU GOT? CHARLES? DID Y'ALL GET THE ENDS? GOOD DEAL. THANK YOU. HA HA HA HA HA. YOU GOT A LITTLE GOOFY. THERE. TAKE IT. REALLY? SLOW. SEE HOW. ALRIGHT. THREE WORDS. HARRELL. HARRELL. HARRELL. ALMA MATER.
IT'S ALL OF THEM. I REALLY GOT A REASON TO GET A REASON. OH I KNOW YOU'RE THE GUY. SO YOU'RE GOING TO ACT LIKE THAT. THANK YOU. THANK YOU. HEY. THANK YOU MAN. APPRECIATE IT. NOW WHAT ELSE? HI, GUYS. BRO. YEAH. THANK YOU. WELL, THAT WAS. TOOK ONE. YOU TALKING LIKE YOU DID? I'M THANKFUL. I THOUGHT I SAW COACH. IT'S A GOOD ONE. I'M JUST GLAD WE'RE ALL HERE. IT'S MORE THAN JUST. IT'S BEYOND THE GAME. THAT'S RIGHT. IT'S BEYOND THE GAME. IT'S LIFE. IT'S LIFE.
EXACTLY. YES, SIR. TAKE CARE. YOU JUST GOTTA REMEMBER TO. WELL, OKAY. IT'S KIND OF HARD TO TOP THAT WITH HAVING A COMMISSIONERS COURT MEETING. Y'ALL CAN MOVE ON. ISN'T IT?
[4. Report from Judge, Commissioner or Department concerning an item/report of community interest.]
YEAH. OKAY, WE'LL GO INTO ITEM 1.4, WHICH IS REPORTS. COMMISSIONER GILLESPIE WILL START ON YOUR END. I JUST WANT TO THANK EVERYBODY WHO CAME TO THE RENAISSANCE FAIR IN INGLESIDE. IT LOOKS LIKE A PRETTY BIG SUCCESS. AND I DON'T HAVE THE FINAL NUMBERS YET, BUT I THINK WE DID REALLY WELL. THANK YOU, MISTER WILKINSON. WE'RE JUST WINDING DOWN THE YEAR TRYING TO FINISH UP THINGS AND PROJECTS. AND THE EMPLOYEE CHRISTMAS PARTY WAS A LOT OF FUN. AND I'VE LEARNED A LOT FROM GRACIE AND COMMISSIONER LOPEZ. AND IT'S JUST NICE TO BE TOGETHER WITH EVERYONE AND ALL THE GIFTS AND THE LAUGHTER AND THE FOOD. THANK YOU. I KNOW THERE WAS A BUNCH OF PEOPLE THAT PUT THAT TOGETHER. NORMA, I CAN'T THANK ALL OF Y'ALL THAT HELPED MAKE IT A SUCCESS. MISTER CHARLIE JUDGE. THANK YOU. GOOD MORNING EVERYBODY. FOR PRECINCT TWO ROAD WORK LAST WEEK, THEY WORKED ON COUNTY ROAD 1906, PATCHING POTHOLES. THEY REMOVED ALL THE DIRT OUT OF THE SHOW. SHOW BARN AT THE FAIRGROUNDS. AND THE REST OF THE DETAILS ARE IN MY REPORT FOR MYSELF. ON TUESDAY, I ATTENDED THE PORT OF CORPUS CHRISTI PORT COMMISSIONER MEETING VIRTUALLY. AND THERE'S TWO KEY ITEMS THAT WERE ADDRESSED. FIRST, THEY AMENDED THE LEASE FOR THE CITY, MARINE AND PORT ARANSAS, ELIMINATING WHAT I WOULD CALL THE HOSTILE[00:20:02]
CLAUSES THAT HAVE BEEN IN CONTENTION FOR YEARS. AND SECONDLY, THEY HAD A PRESENTATION ON THE PORT SCENARIO BASED LAND USE PLANNING PROCESS, WHICH LOOKS TO BE A MORE TRANSPARENT APPROACH TO THEIR LAND USE. AND BOTH OF THESE ACTIONS REFLECT A POSITIVE CHANGE IN LEADERSHIP AT THE PORT. SO I'M HAPPY TO SEE THAT HAPPEN. THURSDAY, I ATTENDED THE CORPUS CHRISTI REGIONAL ECONOMIC DEVELOPMENT CORPORATION BOARD MEETING, AND I'LL LET YOU KNOW THAT THEIR ANNUAL GENERAL MEETING WILL BE HELD JANUARY 22ND. SO ANYBODY WANT TO ATTEND THAT? PUT THAT ON YOUR CALENDAR. AND FINALLY, I'D LIKE TO WISH EACH OF YOU A VERY MERRY CHRISTMAS AND REMIND YOU TO STAY SAFE, ESPECIALLY THOSE OF YOU WHO ARE TRAVELING OUT OF TOWN.THAT'S ALL I HAVE, JUDGE. COMMISSIONER LOPEZ. I JUST WANT TO SAY HOW MUCH FUN I HAD AT THE CHRISTMAS PARTY. AND YES, IT WAS A LOT OF LADIES THAT THAT PUT IN A LOT OF WORK TO DO THAT. THANK YOU, GREG, FOR THE DECORATIONS. IT LOOKED BEAUTIFUL AND WE HAD A GOOD DJ. THE FOOD WAS FANTASTIC.
EVERYTHING WAS VERY NICE. THANK YOU. COUPLE OF THINGS. NORMA, THANK YOU FOR PUTTING ALL THAT TOGETHER. PHENOMENAL. I THINK IT'S EVERY YEAR IT GETS BETTER AND BETTER. SO THIS YEAR PROBABLY TOPPED EVERYTHING ELSE. SO THANK YOU VERY MUCH FOR YOU AND YOUR STAFF, EVERYONE THAT HELPED YOU PUT THAT TOGETHER. THE OTHER THING THAT I HAVE, I GUESS THIS IS DIRECTED MOSTLY TO PEOPLE PROBABLY THAT DON'T LIVE IN SINTON, CITY OF CORPUS CHRISTI. IT'S SUPPOSED TO ANNOUNCE TODAY THAT WE WERE GOING TO BE GOING ON WATER RESTRICTIONS, THE THIRD STAGE.
SO PLEASE BE ALERT. PLEASE LOOK AT THOSE RESTRICTIONS AND SEE WHAT YOU CAN DO. VERY LITTLE, I THINK, IS WHAT YOU CAN DO. THE THINGS THAT YOU'RE NOT SUPPOSED TO BE DOING AND STUFF FOR Y'ALL THAT LIVE HERE IN SINTON, Y'ALL DON'T HAVE TO WORRY ABOUT IT. BUT FOR THE REST OF THE COUNTY, EVERY CITY AND THE COUNTY IS GOING TO BE ON STAGE THREE WATER RATIONING. AND FROM THE LOOKS OF IT, THERE'S NO RAIN IN SIGHT. SO HOW LONG WE'RE GOING TO BE ON IT? I DON'T KNOW, SO WE'LL SEE.
ANY STAFF MEMBER HAVE ANYTHING? STAFF DEPARTMENT HEADS. Y'ALL HAVE ANYTHING THIS MORNING? OH.
OH, I WAS GOING TO SAY I'M SHOCKED. IF I MAY, I'D LIKE TO YIELD TO TWO POINT FOUR. SAM IS IF I CAN DO MY COMMENTS, THEN. OKAY. THANK YOU, THANK YOU. GOOD MORNING. GOOD MORNING. JUST A FRIENDLY REMINDER OF TURNING IN TIME SHEETS, PLEASE. AS SOON AS POSSIBLE. WE'LL HAVE TO RUN PAYROLL EARLY. THANK YOU. OKAY. WE'RE GOING TO SOME EXTREMELY SHORT WEEKS, AND THIS TREASURER'S OFFICE IS GOING TO BE REAL CRAMPED GETTING EVERYTHING DONE. BUT BETWEEN NOW AND THE END OF THE YEAR, SO PRETTY. HELLO, JUDGE AND COMMISSIONERS. AND ON YOUR TABLETOPS THERE I HAVE PUT A FLIER SO THE VETERANS OFFICE WILL BE DONATING OR GIVING AWAY $5,025 GIFT CARDS THIS WEEK ON FRIDAY TO VETERANS OF SAN FRANCISCO COUNTY. THEY JUST COME BY THE OFFICE, THEY CAN PICK THEM UP THERE. SHE'S GOT TO SHOW PROOF THAT THEY'RE A VETERAN.
EITHER A COPY OF THEIR DD214 OR ON THEIR DRIVER'S LICENSE AND PROOF OF RESIDENCY WITHIN THE COUNTY. THIS ISN'T VALID. I'M SORRY. THIS ISN'T VALID. IT'S NOT VALID. IT'S BEEN SHARED ON FACEBOOK, SO THAT'S SUPER VALID. SO THANK YOU VERY MUCH. OKAY. THANK YOU. GREAT. GRACIE, DO YOU WANT TO SAY SOMETHING? OKAY. OKAY. OKAY. IF NO OTHER. ANYBODY HAVE ANY REPORTS? WE'LL GO AHEAD

ACTION. REQUEST FOR MELANIE COOPER. GRANT MANAGEMENT FOR A RESOLUTION AFFIRMING CIVIL RIGHTS AND DESIGNATING LABOR STANDARDS OFFICER AND A CIVIL RIGHTS OFFICER TO REAFFIRM OUR POLICIES ON CIVIL RIGHTS. AND ALSO, WE HAVE A RESOLUTION THERE TO SIGN, AND IT REAFFIRMS THE POLICIES WE ALREADY HAVE IN PLACE THAT HAS BEEN APPROVED BY THIS COURT. AND THEN I'M ALSO ASKING FOR A DESIGNATED LABOR STANDARDS OFFICER AND CIVIL RIGHTS OFFICER. WE HAVE A LOT OF CONSTRUCTION PROJECTS GETTING STARTED AND CONSTRUCTION AREA, AND IT'S SOMETHING WE NEED TO LOOK AT AND LOOK IN ON AND IMPROVE. AND I WOULD SUGGEST MISTER CHRIS DORSEY BE DESIGNATED AS THE OVERSIGHT FOR THOSE DOCUMENTS. MAY I ASK A QUESTION? SURE. LET ME GET A MOTION A SECOND. LET'S ASK SOME QUESTIONS FIRST BEFORE WE GIVE A MOTION. I THINK THAT'D BE BETTER RIGHT NOW. OKAY, OKAY. GO AHEAD. SO YOUR CASELOAD THAT YOU'RE WORKING ON WILL YOU HAVE TIME FOR IS THIS AN ADDITIONAL LOAD PLACED UPON YOU? YES, SIR. I'M CONCERNED ABOUT YOU BEING OVERWORKED. I CAN WORK HAND IN HAND WITH THE GRANTS DEPARTMENT. I THINK WE CAN. WE CAN SUCCESSFULLY FULFILL THIS OBLIGATION. WHAT KIND OF HOURS ARE YOU PUT IN ON? THIS WILL BE SETTING UP A SYSTEM FOR THE COUNTY TO UTILIZE TO GO INTO THE GRANT MANAGEMENT PLAN ON THE DOCUMENTS AND THE WE HAD AN AUDIT. WE NEED TO MAKE SURE THESE DOCUMENTS COME IN. IN THE PAST WE HIRED A COMPANY TO COME IN AND DO THAT. BUT THE COUNTY NEEDS MORE OVERSIGHT ON THIS PROCESS AND MAKING SURE WE HAVE THE CORRECT DOCUMENTS AND STRUCTURE IN PLACE. SO THIS THIS WILL TAKE AND PUT THAT IN PLACE IN PART OF THE GRANT MANAGEMENT PLAN. AND WORKING WITH MR. DORSEY AS AN ATTORNEY AND LOOKING AT THESE FEDERAL REQUIREMENTS THAT WAY WE HAVE AT LEAST TWO PEOPLE IN THE COUNTY WHO KNOWS WHAT'S GOING. SO THIS IS HE'S GOING TO BE THE LABOR STANDARDS OFFICER AND THE CIVIL RIGHTS OFFICER. THAT IS CORRECT. THE CLAIM IS $2,719.30. SO ONE OF OUR COUNTY EMPLOYEES DID STRIKE THE AIRCRAFT AND DID THE DAMAGE. AND WE SPOKE WITH THE AUDITOR'S OFFICE, PATRICIA GILMORE, AND WE'RE WAITING ON JEFF TO SUBMIT THE DOCUMENTS FOR IT. AND EVEN JEFF REALIZED IT WAS OVER A YEAR, SO THAT CLAIM WAS DENIED. SO WE'RE ASKING THE COURT TO APPROVE THE $2,700 TO PAY FOR THIS. IT HAPPENED. I MOVE TO APPROVE. SECOND. A MOTION A SECOND BY WILKERSON. ANY QUESTIONS? COMMENTS? SO THE ONLY REASON IT'S DELAYED IS BECAUSE THE INDIVIDUAL FILING CLAIM DIDN'T FILE THE PAPERWORK ON TIME. THEY DIDN'T SUBMIT THE JEFF DID NOT SUBMIT THE DOCUMENTS TO US IN A TIMELY MANNER. SO WHEN MR. GILMORE SUBMITTED IT TO THE INSURANCE COMPANY, THEY DENIED IT FOR BEING OVER SIX MONTHS OLD. THERE WERE SOME OTHER THINGS THEY PUT IN THERE, BUT THAT WAS THE BASIS OF THE CLAIM. DENIAL WAS IT WAS PAST SIX MONTHS. IF WE APPROVE THIS HERE, THEN THE INSURANCE COMPANY WILL THEN COVER IT. NO, NO, IT WILL COME OUT OF MY BUDGET. OKAY. AND HE DOES HAVE WHAT, MR. WENDEL? THE DEDUCTIBLE FOR THIS CLAIM IS $10,000. SO IT WOULD HAVE BEEN INSURANCE COMPANY WOULD NOT HAVE PAID ANYWAY BECAUSE IT'S BELOW THE LIMIT. SO WE COULD WE COULD PAY THIS ONE DIRECTLY WITHOUT TECHNICALLY FILING A CLAIM IF YOU WISH. SOUNDS GOOD. EASY. DID I MOVE TO APPROVE? YEAH, WELL, I GOT A MOTION IN A SECOND WITH YOU. SECOND? OKAY. [q. Consideration and action on allowing the District Attorney to use contingency funds until SB22 funding is released. SB22 allows for retroactive payment of qualified expenses under this bill; Commissioners Court of 8 January 2024 approved the allocation of SB 22 qualified funding for District Attorney office.]
TO USE CONTINGENCY FUNDS UNTIL SB 22 FUNDING IS RELEASED. SB 22 ALLOWS FOR RETROACTIVE PAYMENT OF QUALIFIED EXPENSES UNDER THIS BILL. COMMISSIONERS. COURT. ON THE 8TH OF JANUARY, 2024 APPROVED THE ALLOCATION OF SB 22 QUALIFIED FUNDING FOR THE DISTRICT ATTORNEY'S OFFICE. SO THE DA'S OFFICE IS ASKING FOR ANOTHER ATTORNEY TO BE PAID OUT OF SB 22. SO JUST LIKE WE DID FOR THIS PAST YEAR, WE'RE JUST ASKING THAT FOR THIS COMING YEA, FOR 2025. DOES THIS IS THIS THE THING THAT'S TIED TO THE BUDGET LINE ITEM TRANSFER? YES, SIR. AND SO WHY IS IT TIED TO THE BUDGET LINE ITEM TRANSFER. BECAUSE THE MONEY IS COMING OUT OF CONTINGENCY. SO THAT'S FOR 2025. FOR 2025. CORRECT. ACTUALLY THE BUDGET LINE ITEM TRANSFERS IS TIED TO 2.4 R.OKAY. THIS THIS ONE WOULD WOULD REQUIRE TEMPORARY FUNDING FROM CONTINGENCY UNTIL THE SB 22 FUNDS ARE DEPOSITED IN THE COUNTY BANK ACCOUNT, WHICH I HAVE NOT SEEN A PRELIMINARY ESTIMATED DATE ON THAT, BUT I'M SURE IT'LL BE PROBABLY SOMETIME IN JANUARY. AND HOW MUCH IS THIS GOING TO BE? I BELIEVE THE ENTIRE GRANT IS THE SAME AS IT WAS FOR 20. OKAY, OKAY. 275. THE ONE ATTORNEY WOULD BE 121 3130 ABOUT 130 PLUS BENEFITS. AND WE HAVE MONEY IN CONTINGENCY TO COVER THAT. CORRECT. OKAY. IT'S A REIMBURSEMENT ANYWAY, SO IT'LL BE ZERO ZERO NET EFFECT TO CONTINGENCY IN THE END. OKAY. I'LL GO AHEAD AND MOVE TO APPROVE. SECOND. MOTION BY SPACE. SECONDED BY YARDLEY. ANY OTHER QUESTIONS? HEARING NONE. ALL THOSE IN FAVOR OF THE MOTION SAY AYE. AYE. ALL THOSE OPPOSED? SAME SIGN. MOTION CARRIES. [r. Discussion, consideration and action on approving a new full time regular Legal Secretary position for the District Attorney's office to paid for out of the contingency fund for 2025. ]
CONSIDERATION, ACTION ON APPROVING A NEW FULL TIME REGULAR LEGAL SECRETARY POSITION FOR THE DISTRICT ATTORNEY'S OFFICE TO BE PAID OUT OF THE CONTINGENCY FUNDS FOR 2025. AND THIS IS THE ONE THAT COMMISSIONER. THAT IS THE BUDGET LINE ITEM. OKAY. VERY GOOD. GOT IT. THANKS. GOOD MORNING. YES, THERE'S A COUPLE OF THINGS ON THAT. AND ONE OF THE MAIN REASONS WE'VE REQUESTED THAT IS WE HAVE HAD TWO POSITIONS IN OUR, IN OUR INTAKE DEPARTMENT, WHICH BASICALLY CONSISTS OF CLERKS, TWO OF OUR LEGAL ASSISTANTS, BRINGING IN ALL OF THE EVIDENCE THAT COMES IN FROM TEN LAW ENFORCEMENT AGENCIES. ONE OF THEM DOES GRAND JURY ALL THE TIME FOR THE INDICTMENTS OF THE CASES, AND THE OTHER ONE'S CONSTANTLY PULLING IT IN, GETTING IT READY THROUGH OUR OUR SYSTEM, WHICH IS TIME CONSUMING. AND WE'VE HAD THE SAME NUMBER OF STAFF IN THAT POSITION FOR OVER A DECADE, DEFINITELY BEFORE MY TIME. AS WE'VE INCREASED IN OTHER POSITIONS, ATTORNEYS AND ALSO IN THE NUMBER OF CASES, I BELIEVE BEFORE 2018 WE WERE[00:50:02]
RECEIVING PROBABLY ABOUT 1000 TO 1200 ANNUAL FILINGS FROM OUR LAW ENFORCEMENT AGENCIES. IN 19. IT WENT UP TO 1900 AND IS CLOSELY GONE UP TO ABOUT 2000 YEARLY. WE'VE NOT INCREASED THAT. THE COUNTY IS SUBJECT TO ALL THE STATE REQUIREMENTS, AND THE COUNTY ATTORNEY'S OFFICE AND THE DISTRICT ATTORNEY'S OFFICE ARE REQUIRED TO KEEP UP WITH A PERCENTAGE THAT THE STATE LOOKS AT AND WHERE THEY COMBINE FIVE YEARS. RIGHT NOW, IT'S 2019 THROUGH 23, AND IN SEPTEMBER WE'RE COMING UP TO THE NEW WHERE THEY'LL LOOK AT THOSE NUMBERS AGAIN. THOSE NUMBERS ARE MERGED.AND WHAT THEY'RE LOOKING AT IS WE HAVE TO COMPLETE OUR CASES, 90% OF ALL THOSE CASES, IN ORDER FOR THE COUNTY TO GET THEIR GRANTS. AND WE'RE TALKING ABOUT EVERY COUNTY GRANT, THE SHERIFF'S OFFICE, ANY SORT OF GRANT FOR EVERY DEPARTMENT IS TIED TO THAT. I THINK WE RECEIVE ABOUT MILLIONS OF DOLLARS IN GRANT MONEY, AND WE ARE ONE OF THE MAIN CONTRIBUTORS TO THAT PERCENTAGE BECAUSE WE HAVE TO HAVE OUR CASES. WE'VE NEVER HAD A PROBLEM WITH IT. WE'VE DONE WELL, AND I DON'T ANTICIPATE I PLAN THAT WE NOT DO THAT. BUT AS WE ARE GETTING MORE AND MORE CASES FILED, THE NUMBER OF CRIME IS TIED TO THE GROWTH IN YOUR COUNTY AND WE'RE GOING TO GROW EVEN MORE. SO I WANT TO BE ABLE TO KEEP UP. WE'RE BEGINNING TO STRUGGLE WITH THAT. AND ONE MORE POSITION WILL REALLY HELP US STAY IN TACT AND MAKE SURE THAT WE DON'T RUN INTO THAT ISSUE.
WHAT MANY COUNTIES DO IS THAT THEY WILL AT THE VERY END, LIKE, FOR INSTANCE, THIS YEAR, DISMISS A BUNCH OF CASES SO THAT THEY DON'T GO AFOUL WITH THAT. AND THAT IS NOT THE BEST PRACTICE, AND THAT'S NOT THE SAFEST THING FOR THE COMMUNITY. SO I WANT TO BE SMART AND PREPARE AHEAD OF TIME. I'M ASKING FOR A POSITION THAT STARTS IN AT 40,000 PLUS BENEFITS, AND I THINK THAT IS CONSIDERING WHAT WE'RE RECEIVING GRANTS A SMART DECISION. THIS WOULD BE STARTING JANUARY 1ST.
YES. YES, SIR. OKAY. I DON'T HAVE ANY MORE QUESTIONS. I APPRECIATE YOUR FORESIGHT. I MAKE A MOTION. WE APPROVE. SECOND. THANK YOU. I GOT A MOTION BY COMMISSIONER LOPEZ.
SECOND. YES. MR. WILKERSON? NO. GILLESPIE. QUESTION. OKAY, WELL, THIS IS COMING OUT OF CONTINGENCY BECAUSE IT WASN'T IN YOUR BUDGET ORIGINALLY. THAT'S CORRECT. THE SECOND YOU WERE SECOND. YES. THAT'S CORRECT. WE DID NOT INCLUDE IT IN THE LAST BUDGET. I PREPARED THAT BUDGET IN PREPARATION. BUT AS I STARTED TO GET INTO THE MUCK OF TAKING OVER IN 2020 AND INTO THE NUMBERS, AND SAM AND I HAVE BEEN TALKING ABOUT ADDING A POSITION, WE JUST ALWAYS HAD SO MANY OTHER THINGS WE NEEDED TO ADD, AND SO THAT WAS THE REASON I CAME AND SPOKE WITH THE AUDITOR'S OFFICE.
AND WE'RE BRINGING THIS BEFORE YOU AT THIS TIME. OKAY. OKAY. COMMISSIONER GILLESPIE SECONDED.
OKAY. THANK YOU. OKAY. THANK YOU. THANK YOU. OKAY. ANY OTHER QUESTIONS? COMMENTS? HEARING NONE. ALL THOSE IN FAVOR OF THE MOTION SAY AYE. AYE. THOSE OPPOSED? SAME SIGN. NOW WE HAVE TO GO BACK TO THE BUDGET LINE. ITEM TRANSFER TO GO BACK AND LET'S DO THAT OKAY. OKAY. I'LL MAKE A MOTION. WE APPROVE THAT LAST BUDGET LINE ITEM TRANSFER FOR 2025. SECOND. OKAY. AYE. THOSE OPPOSED? SAME SIGN. A TRANSFER CARRIES. GOOD. OKAY. 2.4 S DISCUSSION,
[s. Discussion, consideration and action on 2025 San Patricio County employee salaries.]
CONSIDERATION AND ACTION ON THE 2025 SAN PATRICIO COUNTY EMPLOYEES SALARIES. BASED ON Y'ALL'S RECOMMENDATION FROM LAST WEEK. WHAT I DID IS I GOT WITH THE AUDITOR'S OFFICE. YOU'LL HAVE TWO SECTIONS. THE TOP SECTION IS POSITIONS. THESE WERE THE ONES THAT WERE REQUESTED DURING BUDGET TIME. AND IT'S MAINLY GOING TO BE RECLASSIFICATIONS GOING FROM CLERK TWOS TO THREES, PART TIME TO FULL TIME BECAUSE IT MAKES AN IMPACT. I INCLUDED THE NAMES ONLY BECAUSE WHEN I DO THE ACTUAL LISTING, Y'ALL WILL REFER TO THOSE. AND THEN OUR JUVENILE DETENTION, WE'RE JUST MOVING. THAT IS A GRADE CHANGE FROM A 106 TO A 107. AND THAT'S GOING TO BE ACROSS THE BOARD FOR ALL OF THOSE. SO OUR NEW ENTRANCE LEVEL FOR DETENTION. THE SECOND PART YOU'LL SEE THERE IS SALARY ADJUSTMENTS. THOSE ARE THE SALARY STEP INCREASES THAT WERE REQUESTED DURING BUDGET TIME IS WHAT I WAS INFORMED. IF YOU LOOK DOWN THE LIST MOST OF THEM ARE LOOKING AT 4.15. YOU'LL HAVE ONE CATEGORY OF FOR GOVERNMENTAL AFFAIRS BASED ON A LICENSE.THAT'S A CATCH UP FROM A COUPLE OF YEARS. TO MAKE SURE WE HAVE THAT UP TO DATE. THEN WE HAVE ONE PARTICULAR THAT GOES OVER THE GRADE 111. SO THAT WOULD BE THE 4.50. I ONLY HAD ONE OF THOSE. EVERYONE ELSE IS 4.15. AND THEN FURTHER DOWN YOU'LL SEE ROAD AND BRIDGE NUMBER FOUR. AT THE HE DID A TWO STEP. THAT'S WHERE THE 8.30 COMES. AND THEN THE OTHER ONES GOING DOWN. THIS
[00:55:02]
IS JUST THE STEPS THAT WERE REQUESTED. THIS IS NOT INCLUDING COST OF LIVING IS COMPLETELY SEPARATE. SO THIS IS WHAT WE'LL PUT IN FOR THAT INITIAL REPORT. IT WILL BE CODED AS THAT. AND THEN THE COST OF LIVING WILL BE ON TOP. QUESTIONS. SO IF WE WANT TO GO UP MORE THAN ONE STEP, IS THAT COVERED IN OUR COMPENSATION POLICY ON HOW THAT WORKS? NO, WE DID HAVE WE HAD A REQUEST BY ELECTED OFFICIAL DURING BUDGET TIME THAT THAT SUBMITTED IT IN TO DO TWO STEPS, AND I SUBMITTED THE DOCUMENTATION TO SUPPORT THAT INCREASE. RIGHT ON THOSE EMPLOYEES AND WHY YOU SEE YOUR BUDGET. I DON'T KNOW WHY I DIDN'T SEE MY BUDGET, MR. WENDELL, DID YOU SEE MY BUDGET? YOU DIDN'T. YES. I DO RECALL THAT YOU SUBMITTED THAT. IT'S BEEN A WHILE SINCE I'VE GLANCED AT IT, THOUGH. ME TOO. I DID SUBMIT IT. YEAH. YES, YOU SUBMITTED IT, BUT YOU SAID IF WE WANTED IT, WE HAD TO EMAIL THEM. THAT'S RIGHT. DID YOU EMAIL ME, SIR? OKAY, OKAY. SO THE ONLY QUESTIONS FROM LAST WEEK TO THIS WEEK, WE HAD A FEW DEPARTMENTS THAT CAME CALLED AND SAID THEY DIDN'T REALIZE THEY COULD ASK FOR STEPS. THEY DIDN'T REALIZE IT HAD TO BE DONE DURING BUDGET TIME IF THEY WERE GOING TO BE EVALUATIONS, NO EVALUATIONS. HOW DO THEY REQUEST IT? CAN THEY REQUEST AFTERWARDS? BUT THAT WAS JUST A PROCESS WITH THE SALARY SURVEY THAT YOU ALL HAD, AND WE'RE WORKING WITH HAVE BEEN WORKING OFF AND ON WITH MAINLY RIGHT NOW. THE COURT'S BEEN USING THAT SALARY STRUCTURE FOR NEW EMPLOYEES BECAUSE WE HAVE KIND OF A GUIDELINE. SO THIS IS THE FIRST TIME WE'RE ACTUALLY DOING THIS STEP. BUT IT IS OBVIOUSLY AS YOU LOOK AT THE LIST, IT'S NOT EVERYBODY ACROSS THE BOARD. IT'S JUST THE ONES THAT ACTUALLY DID REQUEST. IN NORMA. ISN'T THERE A COUPLE THAT THE COMMITTEE IS GOING TO LOOK AT? THE COMMITTEE HAS NOT INFORMED ME OF LOOKING AT ANYTHING. THERE'S SOME, I THINK REQUEST, ISN'T THERE, DEBORAH? WE HAVE WE HAVE A JOB THAT'S BEING REVIEWED THAT'S SEPARATE FROM THE SALARIES THAT I'M LOOKING AT HERE. I KNOW THAT THAT HAS IS PENDING GOING TO COMMITTEE, BUT IT'S FOR A REVIEW OF AN ACTUAL JOB. RIGHT, RIGHT. WE'VE HAD REQUESTS FOR A JOB RECLASSIFICATION. I JUST I JUST KNOW OF ONE THAT IS NOT INCLUDED IN THIS PARTICULAR. OKAY. I HAD REQUESTED AN INCREASE ON JUST A FEW EMPLOYEES THAT WENT FROM CREWMEN THAT ARE OPERATING EQUIPMENT NOW IN MY BUDGET.OKAY. I JUST NEED YOU TO SEND ME AN EMAIL. I DID NOT GET. WHEN WE THEY DO BUDGET PRESENTATIONS, I DON'T ALWAYS GET THOSE BUDGETS SUBMITTED TO ME. SO WHAT I DO IS I RELY ON THE AUDITOR'S OFFICE AND THEN THEY BRING ME THE LIST OF WHAT THEY WENT THROUGH. SO IF IT'S SOMETHING THAT WAS SUBMITTED DURING BUDGET TIME AND IT IS NOT ON MY LIST, I DID NOT GET IT. SO I WOULD JUST NEED AN EMAIL IF YOU DON'T MIND. THAT WAY I HAVE THAT. SO WHEN WE DO AUDIT, THAT'S PART OF THAT INCREASE THAT I PUT IN THERE. THANK YOU. SO SOMEHOW WE HAVE TO GET OUR COMPENSATION AND CLASSIFICATION PLAN IRONED OUT SO THAT ALL OF OUR ELECTED OFFICIALS AND DEPARTMENT HEADS UNDERSTAND HOW THIS PROCESS WORKS. I KNOW THIS DOESN'T NECESSARILY FALL ON YOU, BUT IN YOURSELF AND THE SALARY COMMITTEE, WE GOT TO GET THIS THING FIXED. AND I KNOW THAT THE ELECTED OFFICIALS, WE WERE ASKED TO GIVE OUR INPUTS LAST JANUARY. SO ALMOST A YEAR AGO, I DON'T KNOW WHAT BECAME OF THOSE INPUTS. I JUST KNOW THAT WE DON'T HAVE A PLAN THAT WORKS CURRENTLY. AND WHEN I READ THROUGH THE PLAN AND THE EMPLOYEE HANDBOOK, TRYING TO DECIPHER HOW I GIVE MY EMPLOYEE RAISES, IT'S NOT VERY CLEAR. NOR IS IT. NOR DOES IT STATE THE WAY WE ACTUALLY DO IT. SO WE GOT TO MAKE SOME CHANGES. I'M NOT ON THAT COMMITTEE. THE AUDITOR AND I WERE NOT ON THAT COMMITTEE. SO WE KIND OF RELY ON WHAT WE HAVE THAT COMES THROUGH THE COURT.
THAT'S PART OF THE PROBLEM. IT'S UNDER REVIEW. ALL RIGHT. WE'RE GETTING OFF THE AGENDA HERE A LITTLE BIT, DEBBIE. IF YOU READ THROUGH THE COMPENSATION THING, IT IS VERY CLEAR HOW TO DO THE STEP PROCEDURE IN THE PLAN. THE PLAN WAS SUBMITTED TO THE COURT. IT WAS ATTACHED TO THE TO THE AGENDA. WE'VE HAD SEVERAL OTHER TIMES WHERE IT'S BEEN ATTACHED TO THE AGENDA. EVERYBODY HAS ACCESS TO IT IF THEY WANT ONE SPECIFICALLY SENT TO THEM, I CAN RESEND IT. WE STILL DO HAVE THOSE THINGS, THE INPUT FROM PEOPLE, BUT WE HAD BEEN DIRECTED TO JUST HOLD OFF ON THAT BECAUSE THERE IS GOING TO BE A REVIEW NEXT YEAR. AND WE DID DO ONE WORKSHOP, BUT THEN WE ASKED FOR THOSE THINGS AFTERWARDS. SO IT IS STILL PENDING. WE STILL HAVE THEM ALL. WE HAVEN'T DONE ANYTHING WITH THEM. IT'S JUST WE WERE TOLD TO WAIT BECAUSE WE'RE GOING TO BE REDOING THE
[01:00:01]
EVALUATION NEXT YEAR OF THE SALARY, SALARIES AND STUFF. AND SO IT DIDN'T MAKE SENSE TO WASTE OUR TIME DOING THAT WHEN WE'RE GOING TO REDO EVERYTHING NEXT YEAR. AND THEN THIS NEW PEOPLE THAT DO THE EVALUATIONS WILL PROBABLY HAVE A BETTER, MAYBE PLAN FOR US GOING FORWARD. SO WE DID OUR WE DID THE SALARY IN 2022. SO WE'RE LOOKING AT THREE YEARS. SO WE DO HAVE A REVIEW FOR NEXT YEAR. SO I'M NOT SURE WHY WE'RE WAITING. I CAN TELL YOU WE HAVE A PLAN THAT DOES NOT WORK. SO ALL RIGHT WELL I WANT TO MAKE A MOTION THAT WE GO AHEAD AND APPROVE THE 2025 SAN PATRICIO COUNTY EMPLOYEE SALARIES. SECOND. OKAY, WE GOT A MOTION IN A SECOND, BUT I THINK SHERIFF RIVERA'S GOT MAYBE SOMETHING TO ADD ON TO THAT. YES. IF I MAY, I PLEASE THE COURT, PLEASE THAT FIRST OF ALL, I'M EMBARRASSED AND DISGUSTED THAT WE DIDN'T KNOW ANYTHING ABOUT THIS 4.15 SITUATION. FOR THE PAST FEW WEEKS, I'VE BEEN SPEAKING WITH MR. WENDEL AND MR. RIVERA ABOUT HOW DO WE ADJUST THE 5% WITH THE EMPLOYEES THAT WE HAVE AND MAYBE MOVE SOME OF THE 5% MONIES AWAY FROM THE SUPERVISORS, WHO ARE PRETTY GOOD STANDING WITH THEIR SALARIES AND ADJUSTED TO GIVE 6% TO THE OTHER EMPLOYEES THAT ARE LOW COST. AND WHAT WOULD IT BE? THE DIFFERENCE? THIS DIFFERENCE IS ABOUT $700 OR $700 TO A $90,000 EMPLOYEE IS NOT A PROBLEM AT ALL, BUT IT IS FOR LOW, LOW PAID EMPLOYEE THAT THEY CAN PASS A PAIR OF GLASSES FOR THE KIDS AND ALL. THEN THEY GET TO LISTEN TO THIS. THE COMMENTS HERE IN A LIVE STREAM ABOUT WHAT WE'RE GOING TO TAKE OFF EARLY BEFORE THE HOLIDAY. WE'RE GOING TO TAKE OFF THE 27TH. WHO'S WE? BECAUSE THESE EMPLOYEES DO NOT GET TO TAKE OFF. THEY DON'T GET TO GO HOME. JAILERS, DISPATCHERS, DEPUTIES. WELL, THEN YOU HEAR THE COMMENT WHETHER THEY MAKE OVERTIME. WELL, THERE'S A DIFFERENT THEORY WITH THAT THAT THE 28 DAY CYCLE PROGRAM DOESN'T REALLY WORK FOR OVERTIME. AND WHY IS THAT? BECAUSE THE EMPLOYEE HAS TO MAKE 171 HOURS EXCEED 171 HOURS BEFORE HE CAN GET OVERTIME. SO WE HAPPEN TO TAKE A DAY OFF BECAUSE HE'S GOT TO TAKE THE KID TO A DOCTOR OR TO THE DENTIST, OR THE OR THE EYE DOCTOR, OR THE OR THE WIFE, OR TAKE A SICK LEAVE, THEN THAT MEANS HE HAS TO WORK ANOTHER EXTRA EIGHT HOURS OF REGULAR TIME TO EXCEED THE 171, SO THOSE EMPLOYEES DON'T SEE THE OVERTIME FOR THESE HOLIDAY LEAVES AND WHAT HAVE YOU. WHEN THE COVID CAME AROUND, OR WHEN NIGHT SHIFTS COME AROUND, OR WHEN FREEZING WEATHER COMES AROUND, THESE EMPLOYEES ARE STILL THERE. SO I THINK EVEN IF WE CAN JUST CONSIDER THE 4.15 FOR THE LOWER PAID EMPLOYEES FOR THE COUNTY AND THE SHERIFF'S OFFICE WOULD MAKE A BIG DIFFERENCE. I'M EVEN AT A POINT TO SACRIFICE THE SUPERVISORS. WE HAVE 35 SUPERVISORS IN OUR SHERIFF'S OFFICE BECAUSE WE'RE THE LARGEST DEPARTMENT IN THE COUNTY. WE HAVE 35 SUPERVISORS. COULD YOU HAVE FOUR SHIFTS? YOU HAVE TO HAVE TWO SUPERVISORS PER SHIFT BECAUSE 300, 238 INMATES REQUIRE SUPERVISION. SOMEBODY NEEDS TO BE IN CHARGE OF THAT RESPONSIBILITY. AND THE SAME THING OUT IN THE FIELD. SOMEONE NEEDS TO BE RESPONSIBLE FOR THAT RESPONSIBILITY. SAME WITH THE DISPATCH. SO WE HAVE FOUR SHIFTS AND THAT MAKES A DIFFERENCE. WE HAVE A COURT STAFF. THEY'RE ALWAYS ASKING FOR MORE HELP AT THE COURTHOUSE. AND I GET COMMENTS ABOUT WHY CAN'T YOU HIRE PEOPLE. WE HAVE 15 OPENINGS FOR THE ENTIRE YEAR. WHY CAN'T YOU HIRE PEOPLE? I WAS PRIVILEGED TO MAKE A TALK OVER A PANEL IN SAN ANTONIO. I THINK JESSE WAS THERE FROM ODEM, LISTENING TO ME SPEAK TO SOME EDUCATORS AND SOME COMPANIES. AND I SAID, THERE'S A DIFFERENCE BETWEEN OUR COMPANY AND YOUR COMPANY IS IF YOUR EMPLOYEE MAKES A MISTAKE. SAME WITH THE COUNTY EMPLOYEE. THEY MAKE A MISTAKE. THEY GET TO GO HOME AND FIND ANOTHER JOB SOMEWHERE ELSE, A DEPUTY SHERIFF OR A DISPATCHER OR A JAILER MAKES A MISTAKE. HE GETS INDICTED. THINK OF MAKING THAT UP. WE WOULDN'T EMPLOY THE ACCIDENTALLY SHOT SOMEBODY IN TAFT OVER A GUN BATTLE WE HAD WITH 2025 SHOTS FIRED AT US, AND HE SHOT A FEMALE BY ACCIDENT. SHE SURVIVED. SHE WAS FINE. SHE MADE IT HOME BEFORE THE NIGHT'S OVER, BEFORE HE EVEN LEFT THE SCENE. AND HE GOT TEN YEARS CONVICTION OVER THAT TEN YEARS, WHAT WOULD TELL THE EMPLOYEE THAT YOU'RE HAVING TO MAKE THIS SALARY SACRIFICES AND WORK THESE HOLIDAYS AND WEEKENDS AND TAKE A CHANCE OF GETTING INDICTED FOR DOING YOUR JOB? I WOULD CONSIDER THEM AS WELL. THANK YOU. SO. I'M NOT SURE HOW MUCH I CAN TALK. I GUESS THIS IS STILL RELATED TO THIS AGENDA ITEM. SO IS THERE A WAY, SHERIFF, FOR YOU TO GIVE STEP INCREASES TO YOUR EMPLOYEES IN QUESTION AND NOT SEPARATE FROM THE 5% COST? THAT'S CORRECT. THE AND JUST THE LEAVE THE SUPERVISORS ALONE. WE'RE TALKING ABOUT 100 AND $148,000 DIFFERENCE TO MAKE THAT WORK AND LEAVE THE 5% ACROSS THE BOARD. LEAVE IT ALONE, BUT ADJUST THE[01:05:04]
SALARY. I'M HAVING TO COMPETE WITH INGLESIDE, ARANSAS PASS, TAFT, SINTON, MATHIS TO GET EMPLOYEES TO WORK AT $50,000 SALARY. WE DON'T MAKE $56,000 FOR DEPUTY SHERIFF MAKES 46. SO THAT'S EMBARRASSING AS IT IS. AND WHY WOULD WE HAVE OPENINGS? WE STILL HAVE. SO I'M JUST SAYING LET'S START SOMEWHERE, AND I Y'ALL DID A GREAT JOB WITH OUR SUPERVISORS. AND I THINK THOSE GUYS WILL SACRIFICE THEIR THEIR 4.15 TO LET THE OTHER FOLKS CATCH UP. BECAUSE WHEN YOU GIVE SOMEONE A 5% RAISE ACROSS THE BOARD, THE $90,000 EMPLOYEE IS GETTING FURTHER AWAY FOR THE LOWER $40,000 EMPLOYEE. IT DOESN'T WORK. THE SALARY PERSON DOESN'T WORK. BUT THAT'S THE ONLY WAY IT WORKS. THAT'S THE WAY YOU CAN MAKE IT WORK, IS TO DO A SALARY ACROSS THE BOARD EVALUATIONS. WE DON'T HAVE EVALUATIONS. I DON'T THINK ANYWHERE IN THE COUNTY THAT HANDLES THAT KIND OF STUFF. BUT I KNOW WHAT MY PEOPLE DO, AND I KNOW THEY'RE OUT THERE WHEN YOU NEED THEM. AND I KNOW THAT THEY SACRIFICE THEIR LIVES EVERY DAY FOR YOU. DEBORAH. DEBORAH, THE SHERIFF'S OFFICE, LIKE YOU SAID, THAT THEY'RE ON THE 28 DAY THING. THIS PLAN DOES NOT WORK FOR THEIR DEPARTMENT BECAUSE THEIR DEPARTMENT IS COMPLETELY DIFFERENT. AND THEY REALLY NEED TO HAVE SOMEBODY LOOK AT HOW THEIR STUFF IS SET UP AND HAVE A SPECIAL SET OF RULES MADE UP JUST FOR THEM SO THAT THEY CAN, LIKE HE SAID, HELP THESE PEOPLE AND ACCOMMODATE THESE PEOPLE.THE SICK TIME, THINGS THAT'S BEEN GOING A PROBLEM FOR YEARS AND YEARS. WHY WE SPLIT THE SHERIFF'S DEPARTMENT OUT FROM THE REST OF THE COUNTY TO BEGIN WITH. OKAY. YES. LET THE SHERIFF DO WHAT HE NEEDS TO DO. CORRECT. OKAY. AND HE. YEAH, HE NEEDS SUPPORT FROM THE COURT. YEAH. WE TRY TO PENNY PINCH AS MUCH AS WE CAN, EVEN TRY TO BUILD OUR OWN CARS JUST TO MAKE IT WORK, BECAUSE IT'S IMPORTANT. BUT WE KNOW WE HAVE A SALARY COMMITTEE. AND WITH 135 EMPLOYEES, WE DON'T HAVE A MEMBER IN THAT SALARY COMMITTEE. HOW DO WE EXPRESS OUR PROBLEMS WHEN WE DON'T HAVE A MEMBER IN THAT COMMITTEE? AND I'VE ASKED WE PUT A MEMBER ON THE COMMITTEE THEN. YEAH. AND WHY DON'T YOU SUBMIT EMPLOYEES THAT NEED THAT RAISE, WHY DIDN'T I NO NO NO NO NO WHY DIDN'T HE KNOW. WHY DOESN'T HE. WHY DON'T YOU I DIDN'T DO IT BECAUSE WE WERE STRUCTURED WHAT THE COURT WAS GOING TO DO. WE'RE NOT TRYING TO BURDEN THE COURT BY ANY MEANS. WELL, I THINK IT'S EASY ENOUGH TO HAVE SOMEONE IN THE SHERIFF'S DEPARTMENT ON THE SALARY COMMITTEE. I DON'T THINK THAT'S A PROBLEM AT ALL. I DON'T EVEN THINK WE NEED TO VOTE ON SOMETHING LIKE THAT, BECAUSE WE'RE A DIFFERENT WORLD. AND HOW DOES THE EMPLOYEE OR THE SALARY COMMITTEE KNOW HOW WE OPERATE? IF YOU DON'T KNOW HOW WE HOW WE FUNCTION, 128 28 DAY CYCLE. REALLY IT'S A BAD SITUATION FOR US. BUT THAT'S THE LAW. WE UNDERSTAND. SHERIFF. YEAH. WE'LL HELP YOU ANY WAY WE CAN. MY APOLOGIES. COURT. NO, NO. IT'S OKAY. YOU NEED TO LET US KNOW. OKAY? MAKE A MAKE A LIST OF THE EMPLOYEES THAT YOU WANT TO GIVE THAT INCREASE TO. I WILL THANK YOU. THANK YOU. OKAY. OKAY. SO WHAT I'M HEARING FROM THE COURT, COMMISSIONER WILKINSON, YOU ARE SENDING ME AN EMAIL? YES, MA'AM.
WITH THE ADJUSTMENTS THAT YOU REQUESTED AT BUDGET TIME. AND THEN THE SHERIFF IS SENDING ME AN EMAIL WITH HIS PEOPLE. AND THEN WHEN? AS SOON AS I GET THAT, THEN I PUT THE BIG REPORT TOGETHER FOR THE AUDITORS SO WE CAN AUDIT. BEFORE I PRESENT TO COMMISSIONERS COURT. GET IT TO YOU TODAY. OKAY. SO WHAT ARE WE DOING? WE CAN GO AHEAD AND APPROVE THIS BECAUSE THAT GIVES ME DIRECTION. Y'ALL, Y'ALL Y'ALL SEEN THIS PARTICULAR LIST THAT'S BEEN SUBMITTED. THAT'S WHAT WE THAT'S SO THAT'S WHAT Y'ALL ALREADY MADE A MOTION. AND THEN ADDITIONAL MOTION WOULD BE COMMISSIONER WILKINSON AND THE SHERIFF'S LIST AT THE NEXT. AND THEN ONCE THEY SEND ME THAT THEN I'LL PUT IT IN THE BIG REPORT AND I WILL STAR IT SO THAT Y'ALL KNOW THOSE ARE ADDITIONALS THAT WERE ADDED ON. OKAY. THANK YOU. SOUNDS GOOD. OKAY. YOU GOT THAT INCLUDED IN YOUR MOTION? SURE.
OKAY. I'M GOOD SIR. OKAY. GOT IT I SEE. OKAY. ANY OTHER QUESTIONS? COMMENTS? HEARING NONE. ALL THOSE IN FAVOR OF THE MOTION SAY AYE. AYE. THOSE OPPOSED? SAME SIGN. MOTION CARRIES. OKAY. 2.4 T IS. DISCUSSION, CONSIDERATION AND ACTION TO AUTHORIZE COUNTY JUDGE

TO GO INTO THAT, SO WE HAVE TO WE MAY HAVE TO. AND I GUESS IF WE NEED TO GO INTO EXECUTIVE SESSION, YOU WILL RECOMMEND THAT TO US OR HOWEVER YOU WANT TO HANDLE IT. WELL, I THINK YOU ALL HAVE ALL THE DOCUMENTATION THERE THAT YOU NEED. I DON'T THINK IT'S NECESSARY TO GO INTO EXECUTIVE SESSION. THE COURT IS WELL AWARE THAT THE COUNTY HIRED A LAW FIRM SEVERAL YEARS AGO TO REPRESENT THE COUNTY IN THIS OPIOID LAWSUITS. WE'VE HAD ANOTHER SETTLEMENT. WE'VE HAD SOME OF THE DEFENDANTS OR RESPONDENTS ENTER INTO BANKRUPTCY THAT I'M STILL GETTING BANKRUPTCY FILINGS OR INFORMATION ON, AND THE TIME IS OF THE ESSENCE ON THIS DOCUMENT THAT WE GOT LAST WEEK. THEY WANTED US TO HAVE IT EXECUTED AND SENT BACK TO THE LAW FIRM BY THE 17TH, WHICH IS TOMORROW. SO I AM RECOMMENDING THAT THE COURT APPROVE THE RESOLUTION AND THE ORDER, AND THAT WE HAVE THE JUDGE SIGN IT AND GET IT BACK TO THE LAW FIRM, MOVE TO APPROVE THE RESOLUTION IN ORDER. SECOND, THAT MOTION SECONDED BY. THANK YOU. SO LAST WEEK I READ SOMEWHERE WHAT OUR PORTION OF THIS WAS. DO YOU KNOW WHAT SAN PATRICIO COUNTY IS EXPECTING TO GET FROM THIS 20?
