[1. CALL TO ORDER, PLEDGES AND PUBLIC INVOLVEMENT]

[00:00:03]

REALLY. GOOD MORNING EVERYONE. WELCOME. IF WE'LL HAVE THE PLEDGES, THEN WE'LL PROCEED. I PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA AND TO THE REPUBLIC FOR WHICH IT STANDS. ONE NATION UNDER GOD, INDIVISIBLE, WITH LIBERTY AND JUSTICE FOR ALL. UNDER THE TEXAS FLAG, I PLEDGE ALLEGIANCE TO THEE. TEXAS. ONE STATE UNDER GOD. ONE AND INDIVISIBLE. OKAY, WELL, GOOD MORNING AGAIN. WELCOME, CITIZENS TO BE HEARD. I DO HAVE ONE CARD THIS MORNING, BUT SHE IS REQUESTING TO SPEAK DURING THE AGENDA ITEM, SO I WILL GRANT HER THAT PERMISSION WHEN WE GET DOWN TO THAT AGENDA ITEM. ANY OTHER CITIZENS TO BE HEARD, ANY OTHER CITIZENS BE HEARD. OKAY. HEARING NONE, WE'LL GO AHEAD AND MOVE ON TO 1.4, WHICH IS OUR REPORT FROM

[4. Report from Judge, Commissioner or Department concerning an item/report of community interest.]

COMMISSIONERS. MR. YARDLEY MORNING, JUDGE. THANK YOU. GOOD MORNING, EVERYBODY, FOR PRECINCT TWO. LAST WEEK, THE ROAD CREW PATCHED POTHOLES ON COUNTY ROAD 1612 AND COUNTY ROAD 3767, AND THEY DUMPED AND SPREAD LIMESTONE BASE ON COUNTY ROAD 3161, GETTING IT READY FOR SEALCOAT.

THEY ALSO HAULED ANOTHER 475 TONS OF LIMESTONE FROM MARTIN MARIETTA AND ROBSTOWN TO OUR COUNTY YARD. FOR MYSELF, ON WEDNESDAY, I ATTENDED THE SOUTH TEXAS MILITARY TASK FORCE QUARTERLY MEETING, AND THERE WERE REPRESENTATIVES THERE FROM THE CITY OF CORPUS CHRISTI, NUECES COUNTY MILITARY PREPAREDNESS COMMISSION, THE NAVAL AIR STATION CORPUS CHRISTI, NAVAL AIR STATION KINGSVILLE, CORPUS CHRISTI ARMY DEPOT, AND THE US COAST GUARD CORPUS CHRISTI SECTOR, AND THE GOVERNOR'S OFFICE. THERE WERE SEVERAL TOPICS DISCUSSED, INCLUDING DIFFERENT GRANTS AVAILABLE FOR LOCAL MILITARY BASES AND THE LACK OF HOUSING FOR JUNIOR ENLISTED. WEDNESDAY EVENING, I ATTENDED THE COASTAL BEND BASIN BASE FOUNDATION ANNUAL FUNDRAISER. THIS IS THE BOOKLET FROM THAT. IF YOU NOTICE EVERYTHING MARKED IN BLUE, THER, THAT IS SOMEBODY FROM SAN PATRICIO COUNTY WHO IS RECOGNIZED. SO AT THIS BANQUET IS AT THE TEXAS STATE AQUARIUM. AND THE AWARDEES THAT HAVE TIES TO SAN PATRICIO COUNTY INCLUDE SANDY RODRIGUEZ WITH GULF COAST GROWTH VENTURES. AND SHE WAS AWARDED THE COASTAL STEWARD PROFESSIONAL AWARD. JEFF MITCHELL GPISD AWARDED EDUCATION K THROUGH 12. ROBERT ADAME FROM HERE IN SINTON, WAS AWARDED THE PRESIDENT'S AWARD, AND DOCTOR DAVID MCKEE ALSO FROM THE CENTENARY HERE, WAS AWARDED THE LEGACY AWARD. SO CONGRATULATIONS TO ALL THE AWARDEES AND LET'S SEE, THAT'S ALL I HAVE. JUDGE REST IN MY REPORT. IF ANYBODY WANTS TO READ IT. THANK YOU, MR. WILSON. THANKS FOR MOVING RIGHT ALONG. AND WE CONTINUE TO SEE IMPROVEMENT IN PRECINCT THREE.

JUST HAVE A GREAT GROUP OF GREAT CREW. IT'S JUST A PLEASURE WORKING WITH THEM. MR. GILLESPIE, I WAS JUST CURIOUS IF I STUMBLED INTO CHURCH BY ACCIDENT THIS MORNING BECAUSE EVERYBODY SITTING IN THE BACK OF THE ROOM AND NOBODY'S DOWN FRON. GOOD TO DEPARTMENT HEADS. THAT'S IT, THAT'S IT. OKAY, I'LL CUT YOU OFF. THAT'S YOUR REPORT. OKAY. GOOD MORNING JUDGE. GOOD MORNING, COMMISSIONERS AND COURT. I JUST WANTED TO REMIND EVERYONE, WITH THE HOLIDAYS COMING UP, IF YOU ALL COULD PLEASE TURN IN YOUR TIME SHEETS AS SOON AS POSSIBLE. I BEG Y'ALL, THAT WAY WE CAN PAY YOU ACCORDINGLY OR YOUR STAFF ACCORDINGLY. THANK YOU. THAT'LL DEFINITELY HELP THEM A LOT. BELIEVE ME. SORRY, JOHN. YOUR TIME IS UP. I PASSED OUT TO YOU GUYS A VERY PRELIMINARY PROPOSED COURTHOUSE RENOVATION. THE COUNTY'S TEAM WENT WITH THE ARCHITECTS TEAM. PRETTY RECENTLY, AND WE HAD WHAT WE CALL A KICK OFF MEETING. BUT PRETTY SOON I'M IMAGINING SOMETIME AFTER THANKSGIVING, THE ARCHITECT TEAM WILL REACH OUT TO THE REST OF THE DEPARTMENTS. THE ADMINISTRATIVE STAFF, AND REVISIT ALL THE SIZING AND SQUARE FOOT OF THE PROPOSED OFFICES. SOUNDS GOOD. THANK YOU. YEAH, WE'RE TRYING TO WORK THIS AT A VERY FAST PACE. NOW, WE DON'T WANT TO GET TOO FAST ON IT BECAUSE MOST OF YOU, IF YOU KNOW THE HISTORY OF THE OLD COURTHOUSE, WHEN WE REBUILT IT AND RE REDO IT, WHAT WOULD 2027 BE? WHAT ANNIVERSARY? THAT'LL BE THE 100TH ANNIVERSARY OF THAT OLD COURTHOUSE. SO WE'RE HOPING

[00:05:07]

AND PRAYING THAT WE CAN GET IT ALL DONE. THEY SAID THAT THEY COULD HAVE MAYBE THE BLUEPRINTS READY BY THE MIDDLE OF 26 SOMETIME OR MAYBE A LITTLE BIT LATER AND THEN START CONSTRUCTION LATER ON THAT YEAR, WHICH THEY'RE TALKING ABOUT 18 MONTHS TO GET THAT THING RENOVATED. SO WE'RE HOPING AND ALSO FOR MOST OF YOU AND I DIDN'T KNOW WHEN I TOOK OFFICE THAT THERE IS A TIME CAPSULE BURIED IN FRONT OF THAT COURTHOUSE JUST BETWEEN THE FLAGPOLE AND THE STEPS GOING UP. SO WE WILL HAVE TO FIND A TIME ONCE THEY START CONSTRUCTION, BECAUSE THE ATRIUM WILL BE ADDED ON TO THE FRONT OF THAT COURTHOUSE. AND WE WILL HAVE TO GET THAT UNEARTHED AND SEE WHAT'S IN THAT TIME CAPSULE. AND MAYBE ONCE IT GETS REBUILT, WE'LL BURY ANOTHER ONE OUT FRONT OF IT SOMEWHERE SO SOMEBODY ELSE CAN OPEN IN THE FUTURE. WOULDN'T THAT IN THE PAPER WHAT THEY PUT IN IT. SO WE ALREADY KNOW I DON'T KNOW, IT'S NOT. 1976 IS WHEN THE VERY WELL I DON'T KNOW WHAT I'M NOT SUPPOSED TO TELL PEOPLE WHAT'S IN IT. SO WE'LL SEE. IT'LL BE A SURPRISE TO ALL OF US. BELIEVE ME. JUST CALL JIM TRACY. HE KNOWS HE KNOWS EVERYTHING. SO. OKAY. ANY OTHER DEPARTMENT HEADS? OKAY. WE HAVE NOTHING. EVERYTHING'S GOING GOOD. OKAY. THAT'S WHAT I WOULD LIKE TO SEE IT. OKAY, THEN WE'LL GO AHEAD AND MOVE ON. IF THERE'S

[1. Approval of minutes]

NO OTHER DEPARTMENT HEADS, WE'LL GO AHEAD AND MOVE ON TO THE APPROVAL OF OUR LAST MEETING.

THE AUDITOR'S OFFICE TO ISSUE AN RFQ FOR ENGINEERING SERVICES WITH FUNDING FROM BUILDING RESILIENT INFRASTRUCTURE AND COMMUNITIES FOR FLOOD MITIGATION AND RESILIENCY PROJECT. COOPER.

HERE WE GO. GOOD MORNING. WE'RE LOOKING FOR AN ENGINEER TO GO OVER OUR MITIGATION PROJECTS FOR THE DRAINAGE PROJECTS. WE HAVE THE 23 DRAINAGE PROJECTS AND WORK ON THE GRANT APPLICATION.

THIS WAS FUNDED THROUGH BRICK AND TITO. MOVE TO APPROVE. SECOND. CAN I GET A MOTION BY GILLESPIE? SECOND BY WILKERSON. ANY OTHER QUESTIONS? THANK YOU FOR THAT. WE'VE WORKED LONG AND HARD FOR THAT. THANK YOU. HEARING NOTHING ELSE, ALL THOSE IN FAVOR OF THE MOTION SAY AYE.

[c. Consideration and action on ratifying the Resolution for the 2025 Indigent Defense Grant Program.]

AYE. THOSE OPPOSED? SAME SIGN. MOTION CARRIES. 2.4 C IS CONSIDERATION. ACTION ON RATIFYING A RESOLUTION FOR THE 2025 INDIGENT DEFENSE GRANT PROGRAM. I THINK THIS IS JUST PROBABLY A RENEWAL. IF I'M NOT MISTAKEN. THAT'S A RENEWAL JUDGE. WE HAD TO SIGN THE. WE HAD THE JUDGE SIGN IT LAST WEEK. IT'S A RENEWAL WITH THE APPLICATION WAS DUE LAST WEEK.

AND SO WE'RE ASKING THE COURT TO RATIFY HIS SIGNING THAT RESOLUTION. ALL RIGHT. I MAKE A MOTION TO RATIFY IT AS OF LAST WEEK. SECOND. I GOT A MOTION BY GILLESPIE. SECOND BY YARDLEY.

ANY QUESTIONS? COMMENTS? HEARING NONE. ALL THOSE IN FAVOR OF THE MOTION SAY AYE. AYE. THOSE OPPOSED? SAME SIGN. OKAY. MOTION CARRIES. 2.4 D. DISCUSSION, CONSIDERATION AND ACTION ON A

[d. Discussion, consideration, and action on a request from Melanie Cooper, Grant Management, on entering into a contract for Fiber Optic Network with FSG Telecom ARPA funded in the amount of $990,369.55.]

REQUEST FROM COOPER GRANT MANAGEMENT ON ENTERING INTO A CONTRACT FOR FIBER OPTIC NETWORK AND FSG TELECOM, ARPA FUNDED IN THE AMOUNT OF $990,369.55. THIS IS FOR OUR FIBER LINE HERE, HERE AT THE COUNTY. IT'S GOING TO CONNECT THE COUNTY BUILDINGS ALL THE WAY AROUND. HAVE WE ALREADY DISCUSSED ALL THIS? YES. MOTION TO APPROVE. SECOND. OKAY. AND A MOTION BY GILLESPIE, SECONDED BY WILKERSON FOR APPROVAL. ALL THOSE IN FAVOR OF THE MOTION SAY AYE. AYE. THOSE OPPOSED? SAME SIGN. MOTION CARRIES. STAY THER. THAT'S IT. OH, NO, THAT'S NOT 2.4. E IS DISCUSSION,

CONSIDERATION AND ACTION ON THE REQUEST FROM SENATORS COUNTY PRECINCT THREE ON TWO QUOTES FOR COMMERCIAL A GRADE BASE, TWO FOR TWO DIFFERENT LOCATIONS LISTED BELOW 16,096 S.H. 188 SINTON, TEXAS 300,000 TONS AT $40.58 PER TON, WHICH IS $121,740, AND THE OTHER ONE IS FROM COUNTY ROAD 1372 AND INTERSECTION AT COUNTY ROAD 2347, SINTON, TEXAS, 2000 TONS, $48, AND $0.38 EQUALS $80,876. AND I DO APPROVE. HAVE IT. OKAY, I GOT A MOTION AND A SECOND, BUT I DO HAVE ONE CARD HERE. THIS PERSON THAT WANTS TO SPEAK ON IT GOT A MOTION BY WILKERSON. SECONDED BY GILLESPI.

MISS WEATHERSPOON. NO, IT'S NOT. GOOD MORNING. MY NAME IS SONYA WITHERSPOON. I LIVE AT 13830 COUNTY ROAD 1694, IN ODUM, THE PRECINCT THREE COMMISSIONER WASN'T PRESENT LAST WEEK WHEN I

[00:30:05]

DEMANDED THAT THE LAME DUCK COMMISSIONERS NOT GET APPROVAL TO SPEND MORE THAN 25,000. NOW THAT THE GENERAL ELECTION IS OVER, I'M HERE TO SPEAK AGAINST AGENDA ITEM 2.4. E, WHERE SHE IS REQUESTING AN ADDITIONAL $202,616 TO SPEND ON BASE, WITH 121,740 OF IT TO BE DELIVERED TO THE YARD ON TEXAS. 188, WITH NO CLEAR DISTINCTION AS TO WHERE IT WILL BE USED, AND WITH THE REMAINING AMOUNT DELIVERED TO COUNTY ROAD 1372. WHEN THIS COURT APPROVED $461,098.50 BE SPENT ON BASE ON AUGUST FIFTH, SHE ALREADY HAD $121,740 DELIVERED TO HER YARD ON TEXAS 188, PLUS 103,978 50 TO COUNTY ROAD 2015 AND 235,380 TO THE FAIRGROUNDS. WHERE DID ALL THAT BASE THAT WAS DELIVERED TO TEXAS? 188 GO. SHE SAID IN THIS COURT THAT SHE DIDN'T USE ALL THE BASE AT THE FAIRGROUNDS. WHERE DID THE EXTRA GO? I SUBMITTED AND AM STILL WAITING ON THE PUBLIC INFORMATION REQUEST FOR THE ACTUAL AMOUNT SPENT ON HER AUGUST 5TH REQUEST, THE COUNTY DID RELEASE INVOICES AND RECEIPTS ON HOW MUCH WAS BULGED TO SOLD TO FIVE CITIZENS.

SINCE THEN, AND THAT WAS ONLY $4,803.44, FOR A TOTAL OF TEN LOADS, WHICH INCLUDED THE COST OF CALICHE HAULING AND SALES TAX PAYABLE. WHEN THEY FINISHED STILL COATING THE ROADS ON HER LIST, I'LL BE SUBMITTING ANOTHER PUBLIC INFORMATION REQUEST FOR THE ACTUAL AMOUNT SPENT ON A REQUEST OF 900,000 THAT WAS APPROVED ON OCTOBER 21ST, AS WELL, ESPECIALLY SINCE ROADS THAT HAVE BEEN SO COATED THAT THAT WEREN'T EVEN ON HER LIST. THAT WAS ATTACHED TO THE MINUTES A WEEK AFTER YOU APPROVED IT. IF YOU APPROVE THIS REQUEST, THAT WILL BE A CUMULATIVE TOTAL OF $663,714.50 SPENT ON BASE, PLUS 900,000 ON SEALCOAT, FOR A TOTAL OF $1,563,714.50. THAT IS WELL ABOVE THE $25,000 LIMIT SET FOR TEXAS LOCAL GOVERNMENT CODE SECTION 130.908. THAT WAS UNANIMOUSLY SIGNED INTO EFFECT AS OF JULY 22ND OF THIS YEAR. CITIZENS HAVE BEEN LED TO BELIEVE HER BUDGET WILL BE LOST IF SHE DOESN'T SPEND IT ALL BY THE END OF THE YEAR. YOU ALL KNOW THAT IS UNTRUE, OTHERWISE IT WOULDN'T STATE YOU MUST ENFORCE SPENDING LIMITS UNDER THE LOCAL GOVERNMENT CODE. SHE STARTED MANY PROJECTS AND DIDN'T COMPLETE THEM OVER THE PAST FOUR YEARS. SHE ONLY HAS SIX WEEKS LEFT OF HER TERM. THERE ARE PLENTY OF POTHOLES THAT NEED FILLED, AS WELL AS MANY DITCHES CURRENTLY FULL OF TREE BRUSH, TREES, BRUSH AND OTHER DEBRIS. I AM PERSONALLY AWARE OF AT LEAST EIGHT MILES OF DITCHES THAT REQUIRE CLEARING. AFTER HER MAINTAINERS SCRAPE BOTH SIDES OF COUNTY ROAD 1694 WHEN THEY PREPPED IT FOR SEALCOAT.

CITIZENS SHOULDN'T HAVE TO CLEAN UP BEHIND THEM IN ORDER TO MOW, OR HAVE OUR CULVERTS CLOGGED BY THEIR DEBRIS WHEN IT RAINS. THANK YOU IN ADVANCE FOR FINALLY ENFORCING TEXAS LOCAL GOVERNMENT CODE SECTION 130.908 AND REFUSING TO APPROVE AGENDA ITEM 2.4.8. THANK YOU, YOUR HONOR. I CAN'T SPEAK TO THIS. FINE. OKAY, WELL, I CAN SPEAK TO IT. IT'S ON THE AGENDA. OKAY. A FEW THINGS TO EXPLAIN TO THE AUDIENCE. I DO THE SAME THING EVERY YEAR WHEN I HAVE EXCESS FUNDS AVAILABLE. I BUY BASE AT TODAY'S PRICES. AND I STORE IT AT MY YARD FOR USE LATER NEXT YEAR. AFTER THE PAVING SEASON STARTS AGAIN. OR I USE IT OVER THE WINTER TO PAY TO PUT DOWN LIMESTONE ON ON DIRT ROADS TO IMPROVE THOSE. FAILING THAT, IF YOU DON'T SPEND YOUR MONEY BY THE END OF THE BUDGET YEAR, THEN YOU CAN ROLL IT INTO CAPITAL IMPROVEMENTS AND ROLL OVER TO THE NEXT YEAR. AND I'LL LEAVE THAT TO MR. MR. AUDITOR THERE TO EXPLAIN THAT FURTHER. IF NOT YOU STILL IT'S STILL LOCKED UP TO THE NEXT YEAR UNTIL ALL THE BILLS ARE PAID FROM THIS YEAR. SO WHAT HAPPENS IF AFTER THAT, MR. AUDITOR? ANY UNSPENT FUNDS IN THE BUDGET ROLL INTO THE FUND BALANCE? TYPICALLY MOST OF THAT IS RE BUDGETED THE FOLLOWING YEAR BECAUSE THE WAY WE PREPARE OUR BUDGETS, WE ASSUME IN OTHER WORDS, WE TRY TO ESTIMATE HOW MUCH OF THE BUDGET WILL NOT BE SPENT. AND THEN THAT A PORTION OF THAT OR ALL OF THAT COULD POSSIBLY BE BUDGETED AGAIN IN THE NEXT YEAR. OR AS YOU STATED, IT IS SOMETIMES ROLLED OVER INTO THE CAPITAL IMPROVEMENTS FUND. OKAY. ALL RIGHT. SO ANY MATERIALS THAT ARE BOUGHT NOW THAT ARE NOT USED NOW WILL STILL BE IN THE YARD FOR THE NEW COMMISSIONER NEXT YEAR. SO THERE'S NOT A PROBLEM WITH BUYING MATERIALS. IT'S NOT LIKE YOU CAN HIDE THEM ANYWHERE. YOU KNOW, THEY'RE PRETTY BIG MOUNDS OF DIRT AND ROCK. SO ANYWAY, I JUST THOUGHT I'D THROW THAT IN THERE. THANKS. I'D ALSO LIKE TO SAY, I'VE SAID THIS MANY TIMES HERE THAT IT'S AN ESTIMATE, THE MATERIAL WE ORDER, AND IF WE SAY USE IT ON COUNTY ROAD 3000, IF WE SAY WE WANT 3000 YARDS AND WE ONLY USE 2500, THEN WE DON'T CALL THE COMPANY TO DELIVER ANOTHER 500 TONS. WE LET IT GO. SO THERE'S NOT AN ISSUE HERE. I WOULD SAY I IF I STOP WORKING ON

[00:35:09]

THE ROAD NOW, I COULD MAYBE GIVE MISS WITHERSPOON THERE HER NAME AND NUMBER AND THEY COULD CALL AND TALK TO HER, BECAUSE I DON'T THINK THEY'RE GOING TO BE VERY HAPPY IF I QUIT IN THE MIDDLE OF A ROAD. AND THE ONLY THING I WANT, OTHER THING I WANT TO CLARIFY, IS THE FACT WE WANT THE $25,000 LIMIT. I ALSO MENTIONED THAT IT WAS NOT THAT WE WOULD APPROVE MATERIALS AS IT CAME ABOUT. SO BECAUSE YOU CAN'T BUY MUCH MATERIALS FOR $25,000 ANYWAY, I'VE SAID MY PIECE.

THANK YOU JUDGE OKAY. ANYTHING ELSE? OKAY. WE GOT A MOTION AND A SECOND. ALL THOSE IN FAVOR OF THE MOTION SAY AYE. AYE. THOSE OPPOSED SAME SIGN. OKAY. MOTION CARRIES. OKAY. 2.4 F.

[f. Discussion, consideration and action on request by Human Resources Department on a job description for a new part time regular Outreach Coordinator position, grade 104 for Public Health Preparedness Department. ]

DISCUSSION, CONSIDERATION AND ACTION ON A REQUEST FROM HUMAN RESOURCES DEPARTMENT ON THE JOB DESCRIPTION FOR A NEW PART TIME REGULAR OUTREACH COORDINATOR POSITION. GRADE 104 FOR THE PUBLIC HEALTH PREPAREDNESS DEPARTMENT. MISS RIVERA PREP IS A GRANT POSITION. GRANT DEPARTMENT THAT WE HAVE. THEY GOT SOME ADDITIONAL FUNDING FOR A PART TIME POSITION THAT'S GOING TO HELP KIM DO SOME OF THE OUTREACH THAT SHE HAS TO HAVE DONE. IT'S JUST AN ADDITIONAL NO COUNTY FUNDS. ALL GRANT IS FOR WHAT PERIOD OF TIME IS IT FOR A YEAR OR IT'S FOR A YEAR FOR ONE YEAR. AND WE WOULD START AS IT'S ALREADY EFFECTIVE. NOW. OKAY. WE'VE ALREADY RECEIVED THE MONEY MOVE TO APPROVE. SECOND I GOT A MOTION MICHAEL SECONDED BY CHARLIE FOR APPROVAL. ANY OTHER QUESTIONS? MR. RIVERA? HEARING NONE. ALL THOSE IN FAVOR OF THE MOTION SAY AYE. AYE. THOSE OPPOSED? SAME SIGN. OKAY. MOTION CARRIES. OKAY, WELL, I CAN CLOSE THE AGENDA ITEM FOR THIS

[3. PERSONNEL-Employment and current employee status changes in accordance with the current personnel policies, County Budget, and State law with notification of such changes to the payroll division of the Treasurer's office.]
