THANK YOU. MORNING, EVERYONE. WELCOME TO COMMISSIONERS COURT. YOU PLEASE RISE. I PLEDGE [1. CALL TO ORDER, PLEDGES AND PUBLIC INVOLVEMENT] [00:00:13] ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA AND TO THE REPUBLIC FOR WHICH IT STANDS. ONE NATION UNDER GOD, INDIVISIBLE, WITH LIBERTY AND JUSTICE FOR ALL. HONOR THE TEXAS FLAG. I PLEDGE ALLEGIANCE TO THEE. TEXAS. ONE STATE UNDER GOD. ONE AND INDIVISIBLE. OKAY. AGAIN. GOOD MORNING AND WELCOME. WE'LL GO AHEAD AND MOVE ON. CITIZENS WILL BE HEARD. I HAVE NOT RECEIVED ANY CARDS. NO CARDS THIS MORNING. I'LL ASK ONE MORE TIME. IS THERE ANYONE IN THE [4. Report from Judge, Commissioner or Department concerning an item/report of community interest.] AUDIENCE, CITIZENS TO BE HEARD? OKAY. HEARING NONE, WE WILL GO AHEAD AND MOVE ON TO REPORTS. JUDGE, COMMISSIONERS AND DEPARTMENT HEADS. FIRST OF ALL, I'M GOING TO START OFF ON MY LEFT END WITH COMMISSIONER GILLESPIE. THANK YOU. IF YOU GO AHEAD AND ROLL. I'M GONNA COME DOWN HERE AND DO THIS THIS MORNING. THIS IS SOMETHING THAT HAS BEEN NEEDED TO BE DONE FOR QUITE A WHILE. YOU TURN UP THE VOLUME COURT WHEN WE'RE ELECTED TO THIS POSITION WHERE WE SIT UP HERE, WE'RE EXPECTED TO BE PROFICIENT EVERY TIME WE COME IN THIS COURTROOM, EVERY TIME WE'RE OUTSIDE OF THIS COURTROOM AND ACTIONS ARE PROFICIENT OR PROFESSIONAL. IN THE PAST, OUR ACTIONS HAVE NOT BEEN ANYWHERE CLOSE TO BEING PROFESSIONAL. THE CITIZENS IN THIS COUNTY ARE GETTING VERY ANGRY AS WHAT'S GOING ON WITH THIS COURT. AND I'VE HEARD RUMORS ABOUT THEY WANT TO DO AWAY WITH EVERYBODY ON THIS COURT BECAUSE OF THE ACTIONS THAT WERE NOT SHOWN IN THE PUBLIC. WE'RE LASHING OUT AT EVERY DEPARTMENT HEAD THAT WE HAVE IN THIS COUNTY FOR NO REASON AT ALL IN PUBLIC. YOU SHOULD BE GOING TO THEM IN PRIVATE AND TALKING TO THEM IN PUBLIC. AND IF THERE'S AN ISSUE, YOU GO TO THEIR SUPERVISOR WITH THAT ISSUE, NOT BRING IT INTO COURT AND DISGRACE THEM IN FRONT OF EVERYBODY THAT'S IN THIS COURTROOM. THAT IS VERY, VERY UNPROFESSIONAL. I DON'T THINK YOU'LL SEE THAT IN ANY BIG ORGANIZATION DOING THAT. WE'VE LASHED OUT AT THE BUILDING AND YARDS DEPARTMENT. WE'VE LASHED OUT AT THE ENVIRONMENTAL DEPARTMENT. WE'VE LASHED OUT AT THE FLOODPLAIN DEPARTMENT. WE'VE LASHED OUT AT THE COUNTY ENGINEER NUMEROUS TIMES. GOVERNMENTAL AFFAIRS. LATELY, OUR COUNTY AUDITOR HAS HAD SOME OF THIS LASHING OUT TO HIM AND EVEN MYSELF AT TIMES IN THIS COURTROOM HAVE BEEN LASHED OUT AT THAT. I'VE BEEN DISCRIMINATORY, NOT PROFESSIONAL, NOT THE PEOPLE THAT WE NEED TO BE SITTING UP HERE IN THIS COURTROOM. AND I CAN BLAME MYSELF FOR SOME OF THESE ISSUES THAT HAVE BEEN GOING ON. OKAY. I WANT TO TAKE THE BLAME BECAUSE WE'RE THE LEADER OF THIS COUNTY. I SHOULD HAVE STOPPED SOME OF IT A LONG TIME AGO. THIS LASHING OUT, THIS HAPPENED IN THIS COURTROOM, AND I'M NOT GOING TO STAND IT ANYMORE. NOT ANYMORE. BECAUSE WE'RE HURTING AND LASHING OUT AT GOOD, DEDICATED EMPLOYEES OF THIS COUNTY THAT ARE DOING A FANTASTIC JOB IN THIS COUNTY. AND AS MISS WITHERSPOON SAID LAST MONDAY WAS A VERY GOOD EXAMPLE OF NOT BEING PROFESSIONAL. WE WERE TALKING ABOUT A POSITION INCORPORATING ANOTHER POSITION INTO THAT BECAUSE OUR PREVIOUS DIRECTOR OF THAT DEPARTMENT DIDN'T HAVE THE QUALIFICATIONS TO INCORPORATE THAT, INCORPORATE THE FIRE MARSHAL INTO HER DEPARTMENT. NOW, I'M TRYING TO DO THAT TO SAVE THIS COUNTY MONEY BY COMBINING BOTH OF THEM, AND I'M GETTING BACKLASH FROM THAT. THAT IS NOT PROFESSIONAL. WE'RE SITTING UP HERE DOING WHAT WE'RE SUPPOSED TO BE DOING FOR THE BETTERMENT OF THIS COUNTY, NOT TO DESTROY THE REPUTATION OF THIS COUNTY. REPUTATION OF THIS COUNTY IS GETTING OUT INTO THE PUBLIC. I WAS UP IN SAN MARCOS FOR OUR MEETING. COUNTY JUDGE FROM NUECES COUNTY ASKED HIM, WHAT IS GOING ON OVER IN YOUR COUNTY? Y'ALL ARE FIGHTING LIKE WE USED TO FIGHT ON THIS COUNCIL. I MEAN, COME ON COURT. I DON'T LIKE IT. AND STANDING HERE BEFORE YOU HIS EMPLOYEES THIS MORNING, I AM NOT GOING TO ALLOW THIS TO HAPPEN ANYMORE TO Y'ALL IN THIS COURTROOM. I'M GOING TO STAND UP TO Y'ALL. AND IF ANY OF THESE COMMISSIONERS HAVE A PROBLEM, I HOPE THEY COME TO ME AS YOUR SUPERVISOR, [00:05:02] BECAUSE MOST OF THESE POSITIONS ARE LASHING OUT. IS THAT ME? ARE THERE UNDER MY SUPERVISION. AND IF I REALLY HAVE TO SAY SO, IT'S RETALIATION IS WHAT IT IS. AND IF I CAN FIND A WAY TO PROVE THAT YOU'RE DOING THIS, IT CAN PUT YOU IN JAIL. AND I HOPE I DO GET TO DO THAT. IF YOU'RE RETALIATING AGAINST ME AND I'LL MAKE A PROMISE TO Y'ALL, THIS MORNING, IT'S NOT GOING TO HAPPEN ANYMORE, OKAY? IF IT STARTS, IT'S GOING TO STOP AS FAST AS IT STARTS. OKAY. THANK YOU. THANK YOU, MISS. THE REASON I ASKED THAT TO BE CUED UP THIS MORNING WAS BECAUSE I AND SEVERAL OF MY OTHER COMMISSIONERS, MAYBE ALL OF THEM, RECEIVED A LETTER. I GOT MINE FRIDAY IN THE MAIL DATED OCTOBER 28TH, 2024. DEAR COMMISSIONER HOWARD GILLESPIE, ON MONDAY, OCTOBER 28TH, 2024, DURING THE SAN PATRICIO COUNTY COMMISSIONERS COURT, SAN PATRICIO COUNTY JUDGE DAVID KREBS ISSUED A THREAT OF JAIL TIME TO ALL SAN PATRICIO COUNTY EMPLOYEES AND RESIDENTS WHOM HE DEEMS TO BE AGAINST HIM IN ACTS HE PERCEIVES AND ARE DEEMED PROTECTED. ACTIVITY OF HIS POSITION. I DIDN'T HEAR THAT. I HEARD HIM SAY HE WAS GOING TO DEFEND ALL HIS EMPLOYEES AND THAT IF ANY OF US WERE LASHED, WE'RE TAKING THINGS OUT ON HIM. THAT HE'D BE AFTER US. I'VE BEEN THREATENED BEFORE BY PLENTY OF PEOPLE AND PLENTY OF OTHER FOREIGN FORCES. I DIDN'T FEEL THREATENED BY THAT SPEECH. THIS THIS THREAT HAS IMPACTED THE EFFECTIVENESS AND EFFICIENCY OF SAN PATRICIO COUNTY COMMISSIONERS COURT. MOST IMPORTANTLY, HIS THREAT HAS PLACED THE ENTIRE SAN PATRICIO COUNTY WORKFORCE IN AN IN THE UNTENABLE ATMOSPHERE OF A HOSTILE WORK ENVIRONMENT. I DIDN'T HEAR THAT EITHER. SO THIS THREAT IS UNJUST AND UNFAIR TO THE SAN PATRICIO COUNTY WORKFORCE. ADDITIONALLY, THE THREAT HAS SUBJECTED HAS SUBJECTED ALL SAN PATRICIO COUNTY EMPLOYEES WITH THE FEAR OF ADMONISHMENT FOR NO JUSTIFIABLE REASON. DIDN'T HEAR THAT EITHER. THE EXPLANATION OFFERED BY JUDGE KREBS DURING COMMISSIONERS COURT FOR THE ISSUED THREAT TO ALL SAN PATRICIO COUNTY, IS BASED ON HIS PERCEPTION OF UNVERIFIABLE CLAIM OF RETALIATION AGAINST HIM, FOR REASONS UNKNOWN TO THE PUBLIC OR EMPLOYEES. FURTHERMORE, THE JUDGE HAS UTILIZED THE SAN PATRICIO COUNTY COMMISSIONERS COURT AS AN AVENUE TO IMPOSE FEAR AND ISSUE THE THREAT. DIDN'T HEAR THAT EITHER. WHAT I HEARD WAS AN APOLOGY. THE BEHAVIOR OF JUDGE KREBS IS EXHIBITING IS UNACCEPTABLE AND UNCHARACTERISTIC OF A JUDGE. THEREFORE, WE, THE EMPLOYEES OF SAN PATRICIO COUNTY, HAVE LOST ALL CONFIDENCE IN HIS PERFORMANCE AND REPRESENTATION OF SAN PATRICIO COUNTY AS A JUDGE. THE HOSTILE WORK ENVIRONMENT CREATED BY JUDGE KREBS ON OCTOBER 28TH, 2024, ALONG WITH HIS VISIBLE OMNIPOTENCE, IS UNETHICAL AND SERVES AS EVIDENCE FOR LOSS OF CONFIDENCE IN HIS ABILITY TO CONTINUE TO LEAD THE SAN PATRICIO COUNTY WORKFORCE. I DIDN'T HEAR THAT EITHER. ALL RIGHT. NOW WE PRAY TO GOD THIS BEHAVIOR OF IMPOSING HOSTILE WORK ENVIRONMENT ONTO THE EMPLOYEES OF SAN PATRICIO COUNTY IS JUSTIFIABLE CAUSE FOR YOUR OFFICE. MY OFFICE TO REQUEST AN INVESTIGATION BASED ON THE UNETHICAL BEHAVIOR OF JUDGE KREBS ISSUING THREATS AND THE EXERCISE OF INSTILLING FEAR ONTO THE WORKPLACE FROM THE UNITED STATES. EQUAL EMPLOYMENT OPPORTUNITY COMMISSION SIGNED CONCERNED EMPLOYEES. COWARDLY ACT. ALL BS. AND OH, BY THE WAY, YOU PUT YOUR STAMP ON UPSIDE DOWN. THANK YOU. OKAY. COMMISSIONER WILKERSON, NO REPORT. MR. YARDLEY. THANK YOU. JUDGE. GOOD MORNING EVERYBODY. ALL RIGHT. FOR PRECINCT TWO ROAD WORK LAST WEEK, WE CONCENTRATED ON PATCHING POTHOLES ON COUNTY ROAD 1612. AND WE CONTINUE TO BLADE AND SHAPE THE DITCH ALONG BOTH SIDES OF COUNTY ROAD 3567 TO GET SOME BETTER DRAINAGE OVER THERE. THE REST OF THE DETAILS ARE IN MY REPORT. IF YOU WANT TO SEE THE DETAILS OF THE REST OF WHAT THEY'VE BEEN DOING FOR MYSELF. LAST WEEK I ATTENDED THE TEXAS ASSOCIATION OF COUNTY ENGINEERS AND ROAD ADMINISTRATORS 2024 CONFERENCE. AND AGAIN, THIS WAS ANOTHER GREAT OPPORTUNITY FOR EDUCATION AND NETWORKING FOCUSED ON ROAD AND BRIDGE BUILDING AND MAINTENANCE. AND THEN I HAVE ONE NOTICE I'D LIKE TO PUT OUT THERE ON VETERANS DAY MONDAY, NOVEMBER 11TH, THE GREGORY-PORTLAND VFW POST 12232 IS HOSTING A GOLF TOURNAMENT AT NORTH SHORE COUNTRY CLUB, AND THIS IS ANOTHER FUNDRAISER EVENT THAT GOES TOWARDS THE POST BUYING THEIR OWN BUILDING. THEY ARE LOOKING FOR SPONSORSHIPS AND GOLF TEAMS, SO IF YOU'RE INTERESTED, I CAN GET YOU THE [00:10:01] FLIER. I ALSO SEND IT TO RUDY AND OUR VETERANS SERVICE OFFICE, AND HE'S ALREADY TOLD ME HE'S POSTED ON HIS WALL IN THERE TOO. SO THERE'S A QR CODE. YOU CAN SCAN IT AND FIGURE OUT HOW TO GET REGISTERED RIGHT FROM THE FLIER. THAT'S ALL I HAVE. JUDGE. COMMISSIONER LOPEZ. OKAY. DEPARTMENT HEADS. GO AHEAD. GABRIEL. MR. A WHILE BACK, WE HAD OUR HEALTH FAIR, AND I KNOW THERE WAS A LITTLE WRAP UP, BUT WE DO HAVE OUR FINAL NUMBERS FOR THAT HEALTH FAIR. WE DID HAVE A TOTAL OF 250 ATTENDEES WHO SIGNED IN. AND WE ALSO HAD A RECORD NUMBER OF VENDORS. WE HAD 67 VENDORS FOR THE HEALTH FAIR. SO THOSE WERE THE FINAL NUMBERS FOR VENDORS AND ATTENDEES. ALSO, WE ARE STILL WORKING ON GETTING THE CLEANUP THAT WE DID. YOU KNOW, CLEAN, CLEANED UP OUT AT THE FAIRGROUNDS. I ALSO WANTED TO THANK THE UP TO YOU PROGRAM FOR THEIR FUNDS AND THIS GRANT. THIS IS THE END OF THE THIRD YEAR FOR THIS PROGRAM AND ALSO TO THE FARM BUREAU FOR THEIR SPONSORSHIP AND THIS PAST EVENT. THANK YOU. ALRIGHT. THIS PAST THURSDAY, HALLOWEEN, WE HAD OUR ANNUAL PUMPKIN CONTEST. GO AHEAD AND GET IT. THIS IS A THESE ARE SAMPLES OF THE PUMPKINS THAT WE HAD DISPLAYED ALL AROUND THE COURTROOM. AND ALL SET AROUND THE BUILDING. THE WAY WE SCHEDULED IT THIS TIME IS TRISH, THANK YOU VERY MUCH. WE TOOK. OH, TRISH IS IN THERE. DEBBIE. SHE TOOK PICTURES AND THEN WE SENT IT OUT TO THE EMPLOYEES. SINCE IT IS OFF SITE AND EMPLOYEES WEREN'T ABLE TO COME IN AND THEY GOT TO VOTE ONLINE, WE BROUGHT THEM IN ON WEDNESDAY AND THEY HAD AN OPPORTUNITY TO LOOK AT THEM AND VOTE. AND WE HAD A LOT OF TALENT. WE HAD A LOT OF CLOSE VOTES COMING IN FOR FIRST, SECOND AND THIRD PRIZES. A LOT OF IMAGINATION FROM OUR COUNTY EMPLOYEES. THAT'S GOOD. THAT'S CUTE. THANK. WE ORIGINALLY WERE GOING TO JUST SHOW PICTURES, BUT I FIGURED THE VIDEO HAD A LITTLE BIT MORE IMPACT KIND OF GOING AROUND SO Y'ALL COULD SEE THE WHOLE PART OF IT. RUBY SLIPPERS. THAT'S CUTE. PICKED. OKAY. GOT IT. OUR SECOND PRIZE WINNER ON THE PUMPKIN CONTEST WAS SAMANTHA ANAYA FROM THE TAX AUTO DEPARTMENT. AND HER PUMPKIN WAS THE ELEPHANT. WOW. AND THEN OUR FIRST PRIZE WINNER WAS THE DISTRICT CLERK'S OFFICE. AND THAT ONE WAS THE STAY PUFF. SO THAT WE HAVE A TRAVELING TROPHY THAT WE USE. SO THEY GET TO GET THAT FOR THE WHOLE YEAR. AND HAVE BRAGGING RIGHTS ON IT. THE SECOND PART OF OUR PRESENTATION IS OUR COSTUME CONTEST. OUR COSTUME CONTEST. WE HAD TEN PARTICIPANTS. OUR JUDGES WERE RANDY HAMLIN, THE FOUNDER OF INDIGO LANE HERE, A LOCAL BUSINESS. MIRANDA BENNETT, BENEDICT FARMERS INSURANCE, AND EDNA GARCIA. AND WE CHOOSE PUBLIC PEOPLE. SO THAT THERE'S NOT ANYBODY SAYING, OH, IT'S A DEPARTMENT HEAD OR ELECTED OFFICIAL. THIS IS OUR GROUP PICTURE OF OUR COSTUME CONTEST CONTESTANTS. WE HAD AN ARRAY OF DIFFERENT ONES. OUR SECOND PRIZE WINNER, WE HAD TWO WIZARD OF OZ. OUR SECOND PRIZE WINNER WAS WIZARD OF OZ. NUMBER ONE, JUDGE LESLIE PULLEN'S, OFFICE JP EIGHT. JUDGE PULLEN WAS THE TIN MAN. DINA GONZALEZ WAS THE SCARECROW. AMANDA MENDEZ WAS THE LION. TIERRA LLAMAS WAS DOROTHY. AND OF COURSE, TOTO WAS HIMSELF. AND THEN OUR FIRST PRIZE WINNER WAS WIZARD OF OZ NUMBER TWO, [00:15:06] RUDY GUZMAN FROM THE VETERANS OFFICE WAS OUR LION. DAVID WENDELL WAS OUR WIZARD FROM THE AUDITOR'S OFFICE MYSELF, I WAS THE WICKED WITCH WITH HR. LISA BAKER WAS DOROTHY TOTO HIMSELF. TRACY CURRY WAS THE TIN MAN, BRENDA LOTTO WAS THE SCARECROW, AND MICHELLE FRICKS WAS GLINDA THE GOOD WITCH. ALL OF US FROM HR. WE EXTEND THE CONTEST WITH AN ACKNOWLEDGMENT OF A PERFORMANCE, BUT OUR GREAT WIZARD OF OZ WIZARD, WENDELL. THANK YOU. OKAY, WHERE'D YOU GET THAT? GET UP. DAVID. I THINK KELLY FOUND IT FOR ME ON AMAZON. OR SHE. SHE GOT IT. SHE BOUGHT IT OFF THE INTERNET SOMEWHERE, SO I HAVE TO GIVE HER THANKS FOR THAT. I WASN'T SMART ENOUGH TO FIND ANYTHING. OKAY. ANY OTHER DEPARTMENT HEADS? OH, MERCY. HE'S NOT. HE DOESN'T. HE'S NOT TOO FAR. IF Y'ALL HAVE QUESTIONS FOR HIM, ONE OF THE THINGS I WANTED TO SAY, I'M SURE MOST OF YOU ALL MAY KNOW, TAX STATEMENTS WENT OUT LAST WEEK. MONDAY, TUESDAY, WEDNESDAY. SOME OF YOU HAVE PROBABLY GOTTEN THEM IN THE MAIL, AND IF NOT, THEY'RE STILL THEY'RE ON THEIR WAY. I'M SURE DEPENDING ON THE POST OFFICE, ONE OF THE THINGS I WANTED TO TALK ABOUT, WE'VE DONE THINGS A LITTLE DIFFERENTLY. THIS YEAR. IN PAST YEARS, WHEN YOU PROTESTED AND YOUR PROTEST HADN'T BEEN HEARD, YOU DIDN'T GET A TAX STATEMENT AND WE WOULD WHENEVER THAT WAS SETTLED, YOU'D GET A YOU'D GET A TAX STATEMENT AT THAT POINT THIS YEAR, WE DID IT DIFFERENTLY. EVERYONE GOT A TAX BILL. EVEN IF YOUR VALUE WAS FROM YOUR NOTICE, COME ON UP HERE, MR. SIMPSON. EVEN IF YOUR VALUE WAS ON YOUR NOTICE, YOU PROTESTED. IT HADN'T BEEN HEARD. YOU'RE STILL GETTING A TAX STATEMENT SO THAT DELINQUENCY DATE IS SET FOR TWO ONE. SO YOU STILL HAVE TO PAY YOUR PROPERTY TAXES BY JANUARY. THE 31ST. SO THERE WON'T BE ANY PENALTY AND INTEREST. BUT YOU HAVE THE OPTION TO PAY WHAT YOU PAID LAST YEAR OR YOU CAN PAY THE UNDISPUTED AMOUNT IN OUR OFFICE. I GUESS BETWEEN ME AND MR. SINCEE, WE CAN CALCULATE THAT FOR TAXPAYERS. BUT WE'VE GOTTEN A LOT OF CALLS. I PROTESTED MY VALUE THIS ISN'T RIGHT. AND I UNDERSTAND THAT WE HAVE A LOT OF SUPPLEMENTS COMING IN AND THEY'LL BE COMING IN. AND ONCE THAT PROTEST IS HEARD AND SETTLED UPON AND I GET THAT CHANGE, I'LL SEND OUT A SUPPLEMENTAL STATEMENT. BUT THAT DELINQUENCY DATE IS SET. SO YOU NEED TO PAY SOMETHING EVEN IF YOU FEEL LIKE, YOU KNOW, EVEN IF YOUR PROTEST HADN'T BEEN HEARD BY JANUARY THE 31ST WE'VE HAD, DO YOU HAVE ANY IDEA HOW MANY PROTESTS WE HAD THIS PAST YEAR? PROBABLY OVER 8000. OKAY. AND SO I THINK IT SOUNDS LIKE A LOT MAYBE. BUT IT IS MORE THAN WHAT WE'VE HAD IN THE PAST. RIGHT. SO WE DID THAT DIFFERENTLY RISING. RIGHT. SO I THINK WHEN WE DID THE FILE FOR THE TO SEND OUT TO THE PRINTERS TO DO THE TAX BILLS, I THINK THEY WERE STILL LIKE, I WANT TO SAY, ABOUT 500 PROTESTS THAT HADN'T BEEN HEARD YET. I MAY BE WRONG. SO AS SOON AS THOSE GET SETTLED AND I GET THE INFORMATION, I'LL SEND OUT A SUPPLEMENTAL TAX STATEMENT. SO I WANTED TO TALK A LITTLE BIT TOO ABOUT ANOTHER EXEMPTION THIS YEAR. IT'S CALLED THE CIRCUIT BREAKER THROUGH THE PROPERTY TAX CODE. BUT WE'RE REFERRING TO IT AS A NON HOMESTEAD CAP ADJUSTMENT. AND I'LL LET MR. TALK A LITTLE BIT ABOUT THAT OKAY. OKAY. YEAH. THE NON HOMESTEAD CAP ADJUSTMENT I THINK IS SOMETHING THAT YOUR SOFTWARE PEOPLE SORT OF DESIGNATED IT AS. BUT EVERYBODY ELSE CALLS IT THE CIRCUIT BREAKER. WHICH MEANS THAT FOR ALL NON HOMESTEADED PROPERTIES THE VALUE CANNOT INCREASE MORE THAN 10% 2020. IS IT 20. YES OKAY. SORRY 2,020%. IN ANY GIVEN YEAR. SO THAT SOUNDS PRETTY STRAIGHTFORWARD. WHEN THE LEGISLATURE MAKES A RULE, I LIKE TO SAY THEY MAKE THE BED AND WE HAVE TO LAY IN IT. THIS SINGLE CHANGE IN THE LAW CREATED MORE HAVOC AMONGST ALL THE SOFTWARE VENDORS THAT TAKE CARE OF MY BUSINESS AND MARCY'S BUSINESS THAN ANYTHING ELSE EVER IN HISTORY THAT I RECALL, AND I'VE BEEN DOING THIS OVER 40 YEARS. I KNOW I DON'T LOOK LIKE IT, BUT I HAVE SO BUT SO THE CIRCUIT BREAKER WAS INFAMOUS IN THE SENSE THAT IT WOULD WHEN YOU START REALLY TRYING TO APPLY IT TO THE DIFFERENT SITUATIONS AND ON A GIVEN PROPERTY, WHO'S THE OWNER, WHO'S THE BUYER AND A SELLER. SITUATION OVER 65 REGULAR HOMESTEAD. NO HOMESTEAD, BUT IT ALSO IT DOESN'T APPLY TO THAT. IT'S MOSTLY ABOUT THE NON HOMESTEADED PROPERTIES. COMMERCIAL PROPERTY ESPECIALLY IS BENEFITING FROM THIS IN A IN A BIG WAY. SO SUFFICE IT TO SAY THAT THAT MOST OF THE SOFTWARE VENDORS HAD MANY MEETINGS OVER THAT PRIOR. 3 OR 4 MONTHS, [00:20:03] PROBABLY AFTER THE LEGISLATURE CREATED THIS SITUATION, RUNNING ALL THE WAY UP UNTIL TAX BILL TIME. AND IT WAS DEFINITELY A CHALLENGE. BUT WE ALL KIND OF ARE ON THE SAME PAGE NOW AND BELIEVE THAT WE'VE GOT IT FIGURED OUT SO THAT ANY PARTICULAR SITUATION THAT COMES UP, WE, THE SOFTWARE VENDORS, HAVE BUILT IN CHANGES IN THE SOFTWARE TO HANDLE THAT. SO HOPEFULLY. BUT I WOULD SAY YOU PROBABLY IF YOU ARE RECEIVING A TAX BILL, IT HAS THE NON HOMESTEAD TAX CAP CAP ADJUSTMEN. TAKE A CLOSE LOOK AT IT. AND IF YOU DON'T UNDERSTAND IT YOU CAN CALL ME OR MARCY AND WE'LL BE HAPPY TO TRY TO GO THROUGH THE DETAILS OF IT FOR YOU SO THAT YOU UNDERSTAND. MAYBE YOU WERE EXPECTING WELL, IT DIDN'T CALCULATE OUT TO A STRAIGHT 20% MAXIMUM OVER THE PRIOR YEAR OR WHAT HAVE YOU. BUT HOPEFULLY WE'RE DOING IT RIGHT. AND SO FAR SO GOOD. SO ANYTHING ELSE ABOUT THAT. SO WHAT YOU'LL SEE IF YOU'RE IF YOU HAVE COMMERCIAL PROPERTY AND IT WENT OVER THE VALUE WENT OVER THE 20%. YOU'LL SEE AN EXEMPTION ON THERE. AND SO WHERE YOU HADN'T SEEN IT BEFORE AND IT'S UP TO A $5 MILLION. IF YOUR PROPERTY IS LESS THAN $5 MILLION. SO YOU KNOW IT'S NOT EVERYBODY, IT'S NOT EVERYONE, BUT BUT YOU WILL SEE AN EXEMPTION ON THERE. AND SO HOPEFULLY IF PEOPLE ARE LOOKING AT THEIR TAX STATEMENTS, WHICH I THINK THEY ARE MORE AND MORE EVERY DAY, YOU HAVE A QUESTION ABOUT IT, JUST CALL OUR OFFICE AND WE'LL BE GLAD TO EXPLAIN IT SO THAT WAS SOMETHING THAT THE LEGISLATIVE LEGISLATURE DID PASS THIS PAST YEAR. SO TO HELP REDUCE PROPERTY TAXES. SO ANY QUESTIONS, MARCY, I WAS ASKED AT CHURCH YESTERDAY, SOME OF THE PEOPLE THAT HAVE ALREADY OPENED THEIR STATEMENT SAID THEY DID NOT SEE THE SENIOR PLAN ON THE STATEMENT WHERE YOU CAN DIVIDE IT UP INTO FOURS. IT'S ON THERE. SO IF THEY'RE IF THEY DIDN'T SEE IT ON THERE, THERE'S SOME REASON, MAYBE THEY DIDN'T GET THE OVER 65 EXEMPTION. IT WAS REMOVED OR FOR WHATEVER REASON THEY NEED TO CALL THE OFFICE. EITHER CALL MY OFFICE OR CALL THE APPRAISAL DISTRICT TO SEE WHY IT'S ON THERE. BUT IT IT ON THERE. THEY'RE ON THERE. YES. I LOOKED AT MINE. YET I'M SCARED TOO. SO BE BRAVE. BE BRAVE. OKAY, THE APPRAISAL OFFICE GENERATES THAT INFORMATION. BUT. AND WE ASSUME THAT, YOU KNOW, IT'S BEING CONVEYED TO MARCY AND HER SOFTWARE. SO I THINK WHAT MARCY IS SAYING IS SHE'S INCLUDING IT ON THE BILL. IF SHE RECEIVED THE FLAG, IF YOU WILL, FROM MY OFFICE TO INCLUDE ON AN OVER 65. I DID SEE THE SAMPLES IN. SO I GET SAMPLES BEFORE I SEND THEM OUT AND THAT FOR, YOU KNOW, FOR PAYMENT OPTION WAS ON THERE. SO THERE MUST BE A REASON. WELL I'LL OPEN MINE TONIGHT WHEN I GET HOME. OKAY. SEE WHAT HAPPENS. OKAY. ALL RIGHT. WELL THANK YOU ALL. OKAY. THANK YOU ROBERT. THANK YOU. MARCY. ANY OTHER DEPARTMENTS? DAVID. JUDGE. PARDON MY NOT GETTING UP, BUT MY BACK IS STILL GIVING ME FITS. I HAVE TWO THINGS THIS MORNING. NUMBER ONE, I'M GOING TO PICK ON GRACIE. YESTERDAY WAS HER ANNIVERSARY. I DON'T RECALL THE NUMBER. WHAT WAS IT? GRACIE? 30. WHAT? 3834. SO I JUST WANT TO CONGRATULATE HER AGAIN ON HER AND MARTIN'S 34TH ANNIVERSARY. QUITE AN ACHIEVEMENT. SO AND THEN. ALSO, I'D LIKE TO INTRODUCE PATRICK KUSHNICK, WHO'S A NEW ADDITION TO OUR OFFICE, ASSISTANT COUNTY AUDITOR FOR THE NEXT TWO MONTHS. AND HE WILL BE APPOINTED SAN PATRICIO COUNTY AUDITOR EFFECTIVE JANUARY 1ST. PATRICK, DO YOU WANT TO GOT A FEW THINGS YOU WANT TO SAY? JUST INTRODUCE YOURSELF. TELL US A LITTLE BIT ABOUT YOURSELF. IN THE EVENT. CONGRATULATIONS TO THESE HIGH SCHOOL SENIORS, THEIR TEACHERS, COACHES ON A JOB WELL DONE. COMMISSIONER. MISS GARZA, WOULD YOU LIKE TO SAY A FEW WORDS ABOUT THE TEAM? THIS IS THE FIRST YEAR THAT I. HELLO, I'M MARTY GARZA AND I AM THE DEBATE COACH AT SINTON HIGH SCHOOL. IT'S QUITE AN HONOR TO BE HERE, ESPECIALLY WHEN I SEE FORMER STUDENTS THAT ARE HERE WORKING FOR YOU AND DOING AN EXCELLENT JOB. BUT THE DEBATE TEAM COMPETED IN HARLINGEN SOUTH THIS PAST SATURDAY. THEIR COMPETITION IS VERY INTENSE. EACH SESSION IS 3 TO 4 HOURS AT LEAST. I THINK, AND THEY DO A LOT OF RESEARCH ON POLITICAL TOPICS, GOVERNMENT TOPICS, AND THEY NOT ONLY RESEARCH WHAT THE TOPIC IS, BUT THE PROS OF IT AND THE CONS OF IT, SO THAT WHEN THEY DO GO INTO COMPETITION, THEY TAKE THEIR STAND AND DEFEND IT. AND THEY DO THAT QUITE WELL. SINCE IT IS MY FIRST YEAR COACHING DEBATE, I'M RELYING ON THEIR EXPERTISE TO HELP ME ALONG BECAUSE I AM TOTALLY NEW AT THIS. BUT I THINK CARLOS WOULD DO AN EXCELLENT JOB. WE COMPETED IN THE PAST AT OH, WHICH HIGH SCHOOL WAS IT? REY REY HIGH [00:30:08] SCHOOL, AND CARLOS PLACED FIFTH FROM A FIELD OF 50 DEBATERS. AND, YOU KNOW, EARNING POINTS TOWARDS STATE AS WELL. SO, CARLOS, CAN YOU COME UP HERE? YEAH. THERE YOU GO. CARLOS I'M ON THE SPOT. WELL, SHE IS CORRECT ON THE FACT THAT WE HAVE AN AMAZING DEBATE TEAM IN THE PAST YEARS, WE HAVE SUCCEEDED CONSTANTLY AT MULTIPLE LEVELS. WE'VE GONE TO STATE TWO DIFFERENT YEARS NOW GOING TO TFA STATE FOR THE FIRST TIME LAST YEAR IN, OH, I THINK IT WAS ABOUT TEN YEARS SINCE SINTON HIGH SCHOOL LAST WENT TO TFA STATE FOR UIL CONGRESS. YEAH, I'M JOKING MYSELF. AND EVEN LAST YEAR WE QUALIFIED FOR NATIONALS. THE THREE OF US MADE THE NATIONAL QUALIFIER. UNFORTUNATELY, WE DID NOT GET TO GO DUE TO CURRENT LIFE EVENTS THAT JUST PREVENTED US FROM GOING. BUT THIS YEAR WE PLAN TO MAKE UIL CONGRESS, STATE IN THREE DAYS. ACTUALLY, AND WE'VE BEEN PREPARING A LOT FOR IT. WE WANT TO GO TO NATIONALS AGAIN THIS YEAR. WE WANT TO MAKE FINALS IN STATE THIS YEAR AND REALLY REPRESENT SINTON HIGH SCHOOL. WE HAVE AN AMAZING TEAM. MADELEINE PEREZ HAS FOUND SUCCESS MULTIPLE TIMES. EDUARDO MATA HAS SHOWN SUCCESS IN MULTIPLE EVENTS. WE WANT TO GO TO MORE LOCAL TOURNAMENTS THAT WE CAN MAKE TFA STATE AS WELL. I HAVE A LOT OF FAITH IN MY TEAM AND I HAVE SPENT FOUR AMAZING YEARS WITH ALL OF THESE PEOPLE. WE WANT TO MAKE SURE PEOPLE ARE CONSTANTLY INTRODUCED TO OUR TEAM. WE WANT TO MAKE SURE WE CAN KEEP SENDING THE MESSAGE THAT SINTON HIGH SCHOOL, DESPITE BEING A FOUR WAY, CAN COMPETE WITH SCHOOLS LIKE FIVE A'S SCHOOLS IN SAN ANTONIO IN HOUSTON, DESPITE WHERE WE ARE, WE CAN STILL COMPETE AT THEIR LEVEL. WE CAN STILL SHOW THAT WE ARE ON THAT LEVEL AND CAN EVEN GO ABOVE WHAT THEY CAN DO. SINTON HIGH SCHOOL DEBATE TEAM IS ONE THAT IS RUN BY LOVE AND PROUDNESS. WE ARE PROUD OF OURSELVES AND WE WANT TO KEEP PUSHING FORWARD. MISS GLASER, I THANK YOU FOR BEING ABLE TO TEACH US AND HELP US THIS YEAR TO CONTINUE TO SUCCEED. AS WELL. I'M VERY PROUD OF YOU AND I HAVE A GIFT FOR YOU, FOR YOU GUYS, AND I WANT TO WISH YOU LUCK WEDNESDAY, AND I HOPE YOU DO MAKE IT TO NATIONALS. THANK YOU. ONCE YOU SEE THAT, YOU WILL STAY. YEP. THANK YOU. THANK. YOU, MISS GARZA. CAITLIN. WANT TO STAND OVER HERE WITH THE WITH THE BOARD IN FRONT OF THE JUDGE? LET'S GO. STAND THE COURT. OKAY. ABOUT ORGANIZATIONAL SKILLS. SONYA, YOU DON'T HAVE TO STAND ON THIS ONE. COME ON. OKAY, PERFECT. OH. OKAY. CONGRATULATIONS. OH, MY. OKAY. THANK YOU SO MUCH FOR THIS. PLEASURE FOR COMING. THANK YOU FOR COMING. THANK YOU. SIR. WHAT'S YOUR NAME? AND YOUR NAME IS. THANK YOU. THANK YOU. GOOD LUCK. OKAY. THANK YOU ALL FOR COMING OUT WITH US THIS MORNING. AND BEST OF LUCK IN YOUR CONTES. OKAY. WE'LL GO TO 2.4 B IS [b. This is a reimbursement grant – grantee is required to provide its own working capital to finance operations. Grant payments will be made to reimburse the grantee for actual expenditures made and supported by adequate documentation.] DISCUSSION CONSIDERATION ACTION ON A REQUEST FROM RUDY GUZMAN, VETERAN COUNTY SERVICES OFFICER, TO APPLY FOR A $100,000 GRANT THROUGH 2025. 26 TEXAS VETERANS COMMISSION FUND FOR VETERANS ASSISTANCE. THIS IS A REIMBURSEMENT GRANT. GRANTEE IS REQUIRED TO PROVIDE ALL ITS OWN WORKING CAPITAL TO FINANCE OPERATIONS. GRANT PAYMENTS WILL BE MADE TO REIMBURSE THE GRANTEE FOR ACTUAL EXPENDITURES MADE AND SUPPORTED BY THE ADEQUATE DOCUMENTATION. RUDY MOVE TO [00:35:01] APPROVE SECOND CARE THAT OKAY GOT A MOTION BY GILLESPIE WHO SECOND THANK YOU SIR CHARLIE, I THINK. ANYBODY HAVE ANY QUESTIONS COMMENTS OR ANYTHING. NO WE'RE WE'RE ALWAYS EXCITED TO SUPPORT YOU AND HELP YOU IN THESE ENDEAVORS WITH THESE TYPES OF. THANK YOU FOR ALL THAT YOU DO. YES, MA'AM. IF I COULD JUST SAY SOMETHING. JUST JUST REAL QUICK SINCE I, I PREPARED. SO I DID WANT TO SAY THAT EVERY BIT OF WORK THAT WE DO IN OUR OFFICE GOES TO HELP OUT EVERY ONE OF THE VETERANS THAT TRAVELS HERE. WE HAVE A LOT OF VETERANS WHO TRAVEL HERE FROM AS FAR AS WE'VE GOT FOLKS THAT COME FROM FROM UP IN DENTON AND DALLAS, FROM SAN ANTONIO AND HOUSTON, THEY COME HERE. BUT BECAUSE THEY HEAR ABOUT THE SERVICES THAT WE PROVIDE IN OUR OFFICE IN THE FIRST TEN MONTHS OF JUST THIS YEAR ALONE, WE'RE AT $2.9 MILLION IN BACK PAY TO THE VETERANS THAT HAVE COME TO SEE US. JUST JUST THIS PAST MONTH, IN OCTOBER, I THINK WE FINISHED IT UP AT NEARLY $400,000 IN BACK PAY FOR JUST THIS ONE MONTH. SO AGAIN, IF ANYONE KNOWS A VETERAN, A SURVIVING SPOUSE WHO HAS APPLIED FOR THEIR BENEFITS AND THEY'VE BEEN DENIED AND THEY YOU KNOW, THEY JUST CAN'T SEEM TO UNDERSTAND WHY THEY CAN BRING THE PAPERWORK HERE TO US. WE CAN WE CAN LOOK THEM UP IN THE SYSTEM. AND IF THERE'S A WAY, WE WILL FIND IT, IF THERE'S A WAY, RIGHT? WE DON'T HAVE SUCCESS WITH EVERYONE WHO COMES INTO OUR OFFICE. HOWEVER, AGAIN, IF YOU KNOW ANYONE OUT THERE WHO IS JUST NEEDS ASSISTANCE, ESPECIALLY WITH THE FINANCIAL ASSISTANCE THAT WE'RE FIXING TO APPLY FOR. AND AGAIN, AND THANK YOU TO THE COMMISSIONERS COURT FOR ALLOWING US TO DO THE WORK THAT WE DO. SO THANK YOU VERY MUCH. THANK YOU. RUDY. OKAY. HAVE A MOTION AND A SECOND. ALL THOSE IN FAVOR OF THE MOTION SAY AYE. AYE, AYE. THOSE OPPOSED SAME SIGN. MOTION CARRIES. OKAY. 2.4 C DISCUSSION, CONSIDERATION AND ACTION TO AWARD BUILDING [c. Discussion, consideration and action to award building project Contract at McCampbell Porter Airport. Recommend awarding bid to Western Steel Company in the amount of $752,361.00.] PROJECT CONTRACT AT CAMPBELL PORTER AIRPORT. RECOMMENDED AWARDING BID TO WESTERN STEEL COMPANY IN THE AMOUNT OF $752,361. ALL RIGHT. THIS IS A 15 ZERO ZERO ZERO SQUARE FOOT BUILDING WITH 12 ROLL UP DOORS, CONCRETE FOUNDATION. IT COMES IN AT $50 A SQUARE FOOT. I MOVED TO APPROVE. SECOND, AIN'T GOT A MOTION BY GILLESPIE, SECONDED BY YEARLEY. ANY QUESTIONS? COMMENTS? SO THE LINE ON THERE TO DELETE THE OVERHEAD DOORS FOR TEN DOORS. SO YOU'RE NOT GOING TO ACTUALLY INSTALL TEN OF THE DOORS. WHAT IT SAYS DELETE TWO DOORS. IT SAYS ALTERNATE ADDITIVE AND DELETION OVERHEAD DOOR DELETION QUANTITY TEN. $12 TOTAL. BUT THEY WANT IT TO D.C. DOORS TO DRIVE THE PRICE DOWN BECAUSE THEY DIDN'T THEY DIDN'T WANT TO DRIVE THE PRICE DOWN OR DELETE THE DOORS. DELETE THE DOORS. OKAY. SO THE BID ITSELF INCLUDES THE DOORS, INCLUDES THE 12 DOORS. YES, ABSOLUTELY. OKAY. GOT A MOTION. AND SECOND, ANY OTHER COMMENTS? WESTERN STEEL. WHAT WHAT ALL WHAT'S THEIR SCOPE. THEY DO THE WHOLE BUILDING. YES OKAY. THEY'RE DOING EVERYTHING OKAY. ANY OTHER COMMENT? ALL THOSE IN FAVOR OF THE MOTION SAY AYE. AYE AYE. THOSE OPPOSED SAME SIGN. MOTION PASSED UNANIMOUS. 2.4 D. DISCUSSION. CONSIDERATION AND [d. Discussion, consideration and action on request from Gary Davis, Airport Manager, on entering into a Master Services Agreement between San Patricio County and Ensolum, LLC for Sinton Airport Remediation Plan] ACTION ON THE REQUEST FROM GARY DAVIS, AIRPORT MANAGER. ON ENTERING INTO A MASTER SERVICE AGREEMENT BETWEEN SAN PATRICIO COUNTY AND ISLAM LLC. FOR CERTAIN AIRPORT REMEDIATION PLAN, THE AIRPORT MANAGER DISCUSS IT. GO AHEAD. I KNOW WHAT IT IS, BUT YOU GO AHEAD AND YOU TALK TO THE FINER POINTS. OKAY, WELL, I COULD DO IT, BUT I'D RATHER PUT YOU ON THE SPOT. THANK YOU. MY PLEASURE. SIR. YOU ALWAYS DO SUCH A GOOD JOB. SO THIS IS THE MASTER SERVICE AGREEMENT WHERE IT'S A REMEDIATION WHERE BRIAN HAS BEEN THE SOLE PRODUCER OF THIS. HE JUST SWITCHED COMPANIES, SO WE'RE KEEPING BRIAN INTO HIS NEW COMPANY. IT'S BEEN REVIEWED BY CHRIS, THE COURT'S ATTORNEY, AND THEY MADE SOME CHANGES AND THEY'VE SENT IT BACK OUT. SO IT'S JUST BASICALLY KEEPING BRIAN AS A POC TO CONTINUE ON WITH THE REMEDIATION PROCESS AT THE AIRPORT. AND THIS TERM IS FOR HOW LONG UNTIL THE TEXAS ENVIRONMENTAL PEOPLE SAY WE'RE GOOD. SO A MONTH OR A YEAR WE'VE BEEN DOING IT SINCE SINCE I KNOW MR. LONG HAVE WE BEEN BEFORE ME? YES, I'LL BE HONEST. I'VE COMPLETELY LOST TRACK. WE'VE BEEN WORKING ON THIS PROBABLY [00:40:03] CLOSE TO 20 YEARS. SEE HOW LONG WE'VE BEEN DOING IT. YOU STARTED IT. WHAT? I'M ALL RIGHT. HE SAYS 32 YEARS. IS THIS REOCCURRING OR THE CONTRACTS? JUST ONE FOR ALL. WELL, UNTIL THE WATER COMMISSION SAYS THAT WE'RE GOOD, CLEAN, THEN WE'LL STILL HAVE THIS CHECKS ON ENVIRONMENT TO MAKE SURE THAT THE WHAT WAS IN IT? ARSENIC. THERE'S A WHOLE LIST OF STUFF ARSENIC, EVERYTHING THEY USE TO KILL BUGS ON PLANTS. YEAH. SO WHEN THAT COMES OUT TO A SAFE STANDARD, THEN WE'LL NOT HAVE TO. OKAY. AND WE ALSO HAVE TO MONITOR THE PLUME THROUGH WELLS AROUND THE AIRPORT AND ON THE ADJACENT PROPERTIES THAT WE DID PURCHASE IN THE PAST. SO WE HAD CONTROL OVER THE PROPERTY TO MONITOR THE PLUMES. AND WE ALSO HAVE A STEEL TANK TRUCK OUT THERE THAT HAS TO BE GOTTEN RID OF AS WELL. THIS WEEK. THANK YOU. SO IS THE FUNDING OR THE COST OF THIS CONTAINED IN A DIFFERENT DOCUMENT THAT WOULD ACTUALLY BE UNDER EMERGENCY MANAGEMENT. THEY'VE BEEN DOING THIS UNTIL SARAH LEFT AND WE HAVEN'T HIRED A NEW ONE YET. SO WE'VE JUST KIND OF TAKEN OVER SWITCHING THE COMPANY AND KEEPING THE SAME EMPLOYEE. SO FUNDING COMES FROM FUNDING COMES FROM THE CAPITAL IMPROVEMENTS FUND. WE HAVE SET ASIDE FUNDS FOR THIS PROJECT. I DO NOT RECALL WHAT THE BALANCE IS AT THIS POINT, BUT I CAN LOOK THAT UP AND SEND YOU AN EMAIL AND LET YOU KNOW THE BALANCE IS BASED ON AN ESTIMATE THAT MR. HANEY PUT TOGETHER PROBABLY FIVE YEARS AGO. THERE'S NOT BEEN A LOT OF WORK DONE SINCE THEN. SO THERE'S STILL A FAIRLY LARGE BALANCE THERE TO DEAL WITH WITH THE ISSUE OF REMEDIATION. BUT I CAN LOOK THAT NUMBER UP AND SEND YOU AN EMAIL AND LET YOU KNOW WHAT'S WHAT IS SET ASIDE FOR THIS PROJECT. SO OBVIOUSLY, THIS HAS BEEN AN ONGOING PROJECT. OR DO WE ARE WE MAKING PROGRESS? YES. ARE THINGS GETTING BETTER? SO WHAT HAPPENED WHEN THEY THE COMPANY FOLLOWED THE FAA PROCEDURES THAT WERE IN PLACE? 30 SOME YEARS AGO WHEN THEY LEF. AND THE COUNTY I KNOW WATER FOLKS CAME IN AND SAID IT WAS ARSENIC AND WE POLLUTED SOMEBODY ELSE'S LAND. THAT'S WHEN THEY COME BACK AND SAID, WELL, THE COUNTY YOU OWN IT BECAUSE THAT'S WHAT THEY DID, EVEN THOUGH THOSE GUYS FOLLOWED THE RULES. SO WE'RE STUCK WITH THE CLEANUP OF THE BILL NOW. RIGHT NOW, WE SPENT MOST OF IT IN REMOVING DIRT, PUTTING CLEAN FILL IN, TAKING THAT OUT. NOW IT'S JUST A MONITORING SITUATION. WE DID HAVE TO BUY SOME PROPERTY FROM TWO HUNT AND WHO WAS THE OTHER ONE? DATES DATES DATES I BELIEVE IT WAS. WE HAD TO BUY THOSE TWO BECAUSE THEIR LAWYERS DIDN'T WANT US TO GO IN AND OUT OF THEIR PROPERTY TO MONITOR, PLUS THEY PROBABLY JUST WANT TO GET RID OF IT. SO WE ENDED UP PURCHASING THAT SO WE COULD PUT THE WELLS ON IT. AND NOW WE'RE JUST MONITORING AND WE'LL MONITOR. AND THERE'S BEEN SOME RESTRICTED COVENANTS FROM NOT A SHALLOW WELL A SHALLOW WELL COULD BE PUT ON IT FOR CATTLE GRAZING. AND THAT SO WE'RE GOING TO OWN IT UNTIL TEXAS DEPARTMENT OF WATER SAYS THAT WE'RE GOOD. AND IT WILL PROBABLY STILL CONTINUE TO MONITOR AT THE MONITORING WELLS IS THE AMOUNT OF ARSENIC OR OTHER THINGS THAT WE'RE TRACKING BEEN DECREASING OVER TIME? IT IS MY IT IS MY UNDERSTANDING, YES, THAT IT HAS BEEN DECREASING THROUGH A THROUGH A NATURAL PROCESS. AT ONE POINT THERE WAS THERE WAS A PLAN TO BEGIN INJECTING CHEMICALS INTO THE WATER THAT WOULD BIND WITH ARSENIC AND SOME OF THE OTHER AND, AND BASICALLY DROP OUT OF SUSPENSION. I DON'T BELIEVE ANY OF THAT HAS BEEN DONE TO DATE. IT IS STILL A NATURALLY OCCURRING SITUATION WHERE IT'S DIMINISHING. BUT WE DO. WE DO NEED TO KEEP BRIAN HANEY ON BOARD, IF AT ALL POSSIBLE, BECAUSE HE'S BEEN WITH US SINCE THE START THROUGH A PROGRESSION OF SEVERAL FIRMS NOW AND HE HAS THE ONE THAT HAS ALL THE INSTITUTIONAL KNOWLEDGE. AND I THINK IF WE WERE TO DO SOMETHING OTHER THAN BRIAN HANEY, IT WOULD JUST DELAY GETTING GETTING US ACROSS THE FINISH LINE. EVENTUALLY. YEAH. AND IT'S ALSO VERY IMPORTANT BECAUSE IT'S NEXT TO THE CREEK, WHICH HAS WATER TRAVELING THROUGH IT. I MAKE A MOTION TO APPROVE. OKAY. GOT A MOTION BY LOPEZ. DO I HAVE A SECOND? SECONDED BY GILLESPIE'S APPROVAL. ANY FURTHER COMMENTS? HEARING NONE. ALL THOSE IN FAVOR OF THE MOTION SAY AYE. AYE. THOSE OPPOSED? SAME SIGN. MOTION CARRIES. THANK YOU. GARY. OKAY. TWO POINT FOR DISCUSSION, [e. Discussion, consideration and action on request from Ruth Cristiana, Health Department-CBP Manager, to amend Health Disparities Project Contract HHS001057600039 with her staff to begin serving the residents of Taft, Edroy, and Odem, Texas per the email authorization received from Michael Avina,CTCM, CHI/LIDS Contracts, Contract Management Section, Department of State Health Services, dated October 2, 2024.”] CONSIDERATION AND ACTION ON A REQUEST FROM RUTH CHRISTINA. HEALTH DEPARTMENT CP B MANAGER [00:45:05] TO AMEND THE HEALTH DISPARITY PROJECT CONTRACT. HHS001057600039 WITH HER STAFF TO BEGIN SERVING THE RESIDENTS OF TAFT, EDROY AND ODEM, TEXAS. PER THE EMAIL AUTHORIZATION RECEIVED FROM MICHAEL AVINA, CM C H I L D S CONTRACTS CONTRACT MANAGEMENT SECTION, DEPARTMENT OF STATE HEALTH SERVICES, DATED OCTOBER 2ND, 2020 FOR MOVE TO APPROVE SECOND. I GOT A MOTION BY COMMISSIONER WILKERSON, SECONDED BY COMMISSIONER GILLESPIE. ANY QUESTIONS? COMMENTS. SO I WILL SAY THAT LOOKED LIKE A VERY LONG EFFORT. THANK YOU VERY MUCH FOR PURSUING THAT AND MAKING IT HAPPEN. I GUESS. OKAY. ANY OTHER COMMENTS? HEARING NOTHING YOU'D LIKE TO SAY? NO. WELL, WE THE GRANT ORIGINATED WITH JASON AND MATHIS AND AS AS WE PURSUE THE GRANT, WE REALIZE THAT THERE'S SO MANY HEALTH DISPARITIES IN BOTH OF THOSE TWO COMMUNITIES. AND MOSTLY MATHIS. AND WE'VE BEEN DOING A NEEDS ASSESSMENT, SURVEYS AND FOCUS GROUPS THROUGHOUT THOSE TWO COMMUNITIES. AND WE FIND THAT THE MAIN THREE HEALTH DISPARITIES THAT STAND OUT IN BOTH COMMUNITIES IS FOOD SHORTAGE AND THE LACK OF TRANSPORTATION. A LOT OF CITIZENS, ESPECIALLY IN MATHIS, THERE'S A LOT OF ELDERLY THAT CANNOT AFFORD VEHICLES, AND THERE'S NO PUBLIC TRANSPORTATION. SO THEREFORE THEY STRUGGLE TO GET JUST TO H-E-B OR TO THE PHARMACY AND THINGS LIKE THAT. AND THE OTHER ONE IS THE FOOD SHORTAGE, TRANSPORTATION AND THE MEDICAL RESOURCES. THERE'S A SEVERE SHORTAGE OF MEDICAL RESOURCES EVEN IN THIS AREA. SO MY JOB FROM THE GRANT, MY GOAL IS TO ADDRESS THOSE DISPARITIES. AND I FEEL THAT AT THIS POINT, WE'VE BEEN FAIRLY SUCCESSFUL BECAUSE WE DID, AS YOU ALL WELL KNOW, THE LAST COUPLE OF MEETINGS, YOU APPROVED THE MOBILE HEALTH UNIT BAN. I GUESS IT'S NOT A BUS TO HELP THE PEOPLE HERE IN THIS COMMUNITY. IN MATHIS, THAT SAME MOBILE UNIT IS GOING, BUT THEY'RE DOING IT THROUGH THE CITY OF MATHIS. THE OTHER DISPARITY, THE FOOD SHORTAGE. WE ARE ADDRESSING A PARTNERSHIP WITH THE FOOD BANK FROM CORPUS. AND THEY WE STARTED THE FOOD THE SENIOR FOOD BOX PROGRAM. AND THAT'S FOR SENIOR CITIZENS 60 OR OLDER. AND WE JUST STARTED THIS, I THINK, ABOUT TWO MONTHS AGO. AND WE'RE AT 100 AND ALMOST 60 PARTICIPANTS. AND THE NUMBERS KEEP GROWING EVERY MONTH. SO THAT'S AN INDICATION THAT THERE IS A NEED. THERE IS A FOOD SHORTAGE, ESPECIALLY AMONG SENIOR CITIZENS. THE 160 IS FOR WHAT COMMUNITIES THOSE ARE THE PARTICIPANTS. THOSE ARE THE PEOPLE THAT WERE HELPING WITH THE SENIOR FOOD BOXES. OKAY. THANK YOU. APPRECIATE ALL YOU DO. THANK YOU. OKAY. I GOT A MOTION AND A SECOND. ANY OTHER COMMENTS? HEARING NONE. ALL THOSE IN FAVOR OF THE MOTION SAY AYE. AYE. THOSE OPPOSED? SAME SIGN. MOTION CARRIES 2.4 F. DISCUSSION, CONSIDERATION AND [f. Discussion, consideration and action on request from Steven Gonzalez, IT Director, to use Courthouse Security Funds for the purchase and installation of a surveillance system, located at the Justice of the Peace #2 Office, in the amount of $1,204.50.] ACTION ON A REQUEST FROM STEPHEN GONZALEZ, I.T. DIRECTOR, TO USE COURTHOUSE SECURITY FUNDS FOR THE PURCHASE AND INSTALLATION OF A SURVEILLANCE SYSTEM LOCATED AT JUSTICE OF THE PEACE TWO OFFICE IN THE AMOUNT OF $1,204.50. I MOVED TO APPROVE SECOND AND GOT A MOTION BY GILLESPIE, SECONDED BY WILKERSON, FOR APPROVAL. WE STILL RUNNING OKAY ON COURTHOUSE SECURITY FUNDS, DAVID, TO COVER IT. OKAY. GOOD DEAL. OKAY. ANY OTHER COMMENTS? OH, IS THERE A CURRENT SECURITY SYSTEM THERE NOW? IS THIS ADDING ON TO THE CURRENT ONE? YES, SIR. ALL THEY'RE GOING TO DO IS REFRESH IT AND RELOCATE SOME OF THE CAMERAS BECAUSE THEY HAD A COUPLE OF BLIND SPOTS. PERFECT. YES, SIR. OKAY. ANY OTHER QUESTIONS? HEARING NONE. ALL THOSE IN FAVOR OF THE MOTION SAY AYE. AYE. THOSE OPPOSED SAME SIGN. MOTION CARRIES. OKAY. 2.4 G. DISCUSSION, CONSIDERATION AND [g. Discussion, consideration and action on request from Leslie Pullin, Justice of the Peace Precinct 8 for $1,000 from Contingency fund to cover shortage in budget for postage/stamps.] ACTION. ON A REQUEST FROM LESLIE PULLEN, JUSTICE OF THE PEACE PRECINCT EIGHT FOR $1,000 FROM CONTINGENCY FUND TO COVER SHORTAGES AND BUDGET FOR POSTAGE STAMPS. I HAVE A QUESTION. MR. WENDELL. IS THERE A CONTINGENCY MONEY THERE FOR THIS? YES THERE IS. I MOVE TO APPROVE. SECOND. [00:50:04] OKAY. GOT A MOTION BY GILLESPIE. SECOND BY WILKERSON. WHEN WE DID LAST YEAR'S BUDGET, WE DIDN'T PLAN ON HAVING TWO POSTAGE INCREASES IN ONE YEAR. AND MOST OF THE DEPARTMENTS EITHER OUT OR RUNNING EXTREMELY, EXTREMELY CLOSE ON POSTAGE. SO WE MAY SEE SOME MORE OF THESE BEFORE THE END OF THE YEAR. I. NOTHING ELS. ALL THOSE IN FAVOR OF THE MOTION SAY AYE. AYE AYE. THOSE OPPOSED? [h. Discussion, consideration and action on San Patricio County Commissioners Court Legislative Agenda for the 89th Session of the Texas Legislature: 1) Support adding two (2) additional Commissioners to the Port of Corpus Christi Authority Commission to represent San Patricio County. 2) Support no Unfunded Mandates. 3) Support / Allow Counties to have more local control - removing lobbyists. 4) Support increasing the bid limit from 50K to 100K HB 1132 by Spiller (88th Leg.). 5) Support the motor fuel tax exemption. 6) Support not to remove any of our private property rights. 7) Support for help with providing rural ambulance service. 8) Support providing reimbursement to counties for HHS mental health commitments when the state does not accept them within the 45 days. HB 3363 by Frank (88th Leg.). 9) Support to include constitutional county Judges in statute as members of the Judiciary for the purpose of longevity pay. HB 2384 (88th Leg.). ] SAME SIGN. MOTION CARRIES. OKAY. 2.4 H. DISCUSSION AND CONSIDERATION ON ACTION ON PATRICIA COUNTY COMMISSIONER'S COURT. LEGISLATIVE AGENDA FOR THE 89TH LEGISLATIVE SESSION OF THE TEXAS LEGISLATURE. I'VE GOT NINE OF THEM ON HERE. NUMBER ONE, SUPPORTING ADDITION, TWO ADDITIONAL COMMISSIONERS FOR PORT OF CORPUS CHRISTI FOR THE COUNTY. NUMBER TWO IS SUPPORT. NO UNFUNDED MANDATES. MOST OF US KNOW ABOUT THAT. WE'RE ALL HAVING THOSE THROWN AT US. NUMBER THREE IS SUPPORT AND ALLOW COUNTIES TO HAVE MORE LOCAL CONTROL. STATE LEGISLATURE IS TRYING TO TAKE AWAY ALL THE CONTROL THAT WE HAVE NOW. AND THEY'RE REALLY PUSHING TO DO AWAY WITH COUNTIES, ESPECIALLY HAVING LOBBYING POWER. AND WE DON'T CALL THEM LOBBYISTS IN THE COUNTIES ANYMORE. WE GOT TO CALL, YOU KNOW, OUR ASSISTANTS IS WHO WE'RE LOOKING AT. YOU KNOW, WE CAN'T LEGALLY HAVE LOBBIES, BUT THEY ARE TRYING TO TAKE IT TO WHERE WE CANNOT USE TAX DOLLARS TO GO TO AUSTIN. IF WE GO TO AUSTIN, WE HAVE TO GO ON OUR OWN POCKET AND EVERYTHING ELSE. SO WE'VE BEEN FIGHTING IT. WE WON IT LAST YEAR AND HOPEFULLY WE CAN DO IT AGAIN THIS YEAR. NUMBER FOUR IS SUPPORT INCREASE IN BID LIMITS FROM 50 TO 100,000. THIS IS SOMETHING ALL COUNTIES ACROSS THE STATE DEFINITELY NEED. IT WAS TRIED IN THE 88TH LEGISLATURE AND ON HOUSE BILL 1132 BY SPILLER AND SPINDLER. SPILLER. MILLER. SPILLER. AND IT WAS DEFEATED. SO WE'RE GOING TO MAKE A BIG, BIG PUSH TO DO THAT. WE NEED TO INCREASE IT. WHEN YOU READ THE HISTORY OF IT, WE'RE STILL $50,000 AT THE COST. WE WERE PROBABLY TEN, 15 YEARS AGO. SO WE NEED TO INCREASE THAT. NUMBER FIVE, SUPPORT MOTOR FUEL TAX EXEMPTION. YOU KNOW, COUNTIES IN THE STATE OF TEXAS ARE THE ONLY ONES THAT HAS TO PAY STATE FUEL TAX. THEY'RE THE ONLY ENTITY EVERYBODY ELSE GETS FREE. AND SO IN OTHER WORDS, ALL YOUR ROAD MATERIAL, ROAD FUEL YOU'RE USING, WE PAY STATE TAX ON IT. AND WE'RE PETITIONING SO WE CAN DO AWAY WITH THAT. WE'RE NO DIFFERENT THAN SCHOOL DISTRICTS AND CITIES AND EVERYTHING ELSE. SO WE'RE GOING TO TRY TO GET THAT NUMBER SIX SUPPORT, NOT TO REMOVE ANY MORE OF OUR PRIVATE PROPERTY RIGHTS. THAT'S PRETTY SELF-EXPLANATORY. THE STATE'S TRYING TO DO AWAY WITH A LOT OF OUR RIGHTS THAT WE HAVE AS PROPERTY OWNERS. SOME OF THE OTHERS ARE MORE OF A NORTH TEXAS PROBLEM. NUMBER SEVEN IS TO HELP PROVIDE RURAL AMBULANCE SERVICES. THIS IS A BIG ISSUE UP IN THE PANHANDLE OF THE STATE OF TEXAS. SOMETIMES IT'S 2 TO 3 HOURS BEFORE AN AMBULANCE CAN EVEN GET TO YOU OUT. IN SOME OF THE AREAS, RURAL AREAS UP IN NORTH TEXAS. AND THEN THERE'S ANOTHER COUPLE OF HOURS FOR THEM TO GET TO A HOSPITAL, OR MAYBE LONGER. SO THEY'RE TRYING TO GET ALL THE COUNTIES IN THE STATE TO HELP, YOU KNOW, GET A BILL THROUGH WHERE THE STATE WILL HELP, HELP THEM GET BETTER AMBULANCE SERVICE AND STUFF UP IN THOSE AREAS. SO WE'RE GOING TO WORK ON THAT. NUMBER EIGHT IS SUPPORT PROVIDING REIMBURSEMENT TO COUNTIES FOR MENTAL HEALTH COMMITMENTS. WHEN THE STATE DOES NOT ACCEPT THEM WITHIN THE 45 DAY PERIOD. THIS WAS BROUGHT UP BY REPRESENTATIVE FRANK AND HOUSE BILL 3363. IN THE LAST SESSION. AND I THINK THE SHERIFF WILL AGREE WITH ME. I DON'T THINK, SHERIFF, YOU'VE GOT A CHECK YET FROM ANY OF THE 45 PEOPLE THAT ARE OVER 45 DAYS IN OUR JAIL AND STUFF. SO WE'VE GOT TO MAKE SURE THAT THAT IS TAKEN CARE OF WHEN WE GO INTO AUSTIN AND NEXT YEAR IN NUMBER NINE, SUPPORT TO INCLUDE CONSTITUTIONAL JUDGES AND STATUTE AS MEMBERS OF THE JUDICIARY FOR THE PURPOSE OF LONGEVITY PAY. THIS WAS ALSO TRIED IN THE LAST LEGISLATIVE SESSION ON HOUSE BILL 2384. SOME OF THE JUDGES THAT ARE IN THE RURAL COUNTIES, THEY HAVE TO TAKE CARE OF ALL THE CASES THAT ARE IN THOSE RURAL COUNTIES. AND ONCE THEY RETIRE, THEY DON'T GET LONGEVITY PAY FOR THE TIME THAT THEY'VE BEEN ON ON THE BENCH. SOME OF THE SMALLER, BIGGER, WITH VERY SMALL POPULATION. BUT THEY HAVE TO DO IT AND STUFF. SO THESE ARE SOME OF THE NINE THAT I HAVE. IF ANY OF THE COMMISSIONERS WANT TO ADD ANY OTHER ONE TO IT. YOU KNOW, IF I OPEN MY TAX STATEMENT TONIGHT, I GUESS ON MY HOUSE, I MAY BE ADDING ANOTHER ONE TO IT. YOU KNOW THAT WE NEED TO LOOK AT THIS TAX, LOOK AT THIS TAX SITUATION THAT THE STATE OF TEXAS HAS BECAUSE IT'S GETTING OUT OF CONTROL AND STUFF. SO [00:55:04] WE'LL I'LL LOOK AT IT AND I'LL BRING IT TO THE COURT. IF WE DO ANYTHING. SO IS THERE ANY OTHER ADDITIONS TO THESE NINE THAT WE HAVE. SO JUDGE, I WOULD SAY THIS IS PROBABLY A GOOD STARTING POINT. I WOULD PROPOSE THAT WE DO SOME SORT OF WORKSHOP WITH OUR KEY LEADERSHIP FROM THE COUNTY AND DETERMINE IF THERE'S OTHER THINGS THAT MAYBE WE SHOULD BE INCLUDING. AND I'D ALSO THINK THAT WE MIGHT WANT TO KIND OF FLUSH THESE ONES OUT A LITTLE BIT. I'LL USE SUPPORT. NO UNFUNDED MANDATES, FOR EXAMPLE. I THINK INSTEAD OF JUST SAYING THAT, WE NEED TO SAY, YOU KNOW, WHEREAS THE ONLY MEANS THAT THE COUNTY HAS TO FUND AN UNFUNDED MANDATE IS THROUGH PROPERTY TAX REVENUE, AS THAT'S THE ONLY WAY WE HAVE TO GET REVENUE. SO EVERY UNFUNDED MANDATE THAT COMES TO THE COUNTY IS AN INCREASE IN PROPERTY TAX. AND WHEN WE PUT IT IN THAT THAT WAY, IT HELPS OUR LEGISLATORS TALKING IDEAS. I MEAN, WHEN WE GO TO AUSTIN, I MEAN, IT'LL BE FINALIZED WHEN WE GET TO US. BUT THIS IS JUST A STARTING POINT TO FIND OUT. DO WE WANT TO ADD ANYTHING ELSE TO THIS LIST? RIGHT. SO I MEAN, IF WE DON'T ADD ANYTHING ELSE TO I, I MEAN, WE WILL WHEN WE GO TO OUR REPRESENTATIVES UP IN AUSTIN. I MEAN, WE'LL, YOU KNOW, HAVE IT, YOU KNOW, WHERE, YOU KNOW, WE'RE ASKING, YOU KNOW, TELLING THEM, HEY, WE'RE TIRED OF PAYING EXTRA TAXES AND STUFF LIKE THAT. WHEN WE GO TALK TO THEM. AND I KNOW WHEN OUR REPUBLICAN PARTY, OUR PLANK, ONE OF THEM WAS NO PROPERTY TAXES. SO, I MEAN, IT MIGHT BE A GOOD IDEA TO DISCUSS IT A LITTLE BIT. WELL, WE CAN ADD ANY OTHER TO THIS. WE WANT TO ADD. THAT'S WHY I'M BRINGING IT UP TO YOU TODAY. WHY DON'T WE JUST TABLE IT FOR NOW SO WE CAN MOVE ON. AND THEN IF ANYBODY HAS ANYTHING ELSE TO ADD OR ANYTHING THEY WANT TO ADD TO AS FAR AS DELINEATION, THEN PLEASE DO SO. YEAH. BECAUSE I'M THINKING ABOUT HOW WE CAN DO THE PROPERTY I UNDERSTAND, I UNDERSTAND I UNDERSTAND DO WE HAVE PROPERTY TAXES? YOU MIGHT AS WELL JUST SEND US ALL HOME. SO BECAUSE IS THAT A MOVE TO TABLE. IS THAT A MOVE TO TABLE TO TABLE. SECOND MOVE BY GILLESPIE. SECOND BY YARDLEY TO TABLE. ALL THOSE IN FAVOR OF THAT MOTION SAY AYE. AYE. ALL OPPOSED. SAME SIGN OKAY. THINK ABOUT IT AND I'LL PUT IT ON FOR NEXT. NEXT WEEK'S AGENDA. AND WE CAN GET THIS FINALIZED BECAUSE I'M READY TO GET IT SENT UP TO AUSTIN. YEAH, I WOULD JUST I JUST RECOMMEND THAT ANYBODY HAS ANY ADDITIONAL INFORMATION. ANYBODY ADD TO IT OR ADD TO THE LIST OR DELINEATE ONE OF THE ITEMS FURTHER. PLEASE SEND IT TO THE JUDGE. YOU DON'T AGREE WITH SOME OF THEM. WE CAN DROP IT, BUT ADD SOME MORE TO IT IF WE NEED TO. OKAY, OKAY, THAT PASSED, MISS GONZALEZ. YOU GOT [i. Discussion, consideration and action on a supplement for retirees' health insurance coverage of $200 a month to be paid for by San Patricio County.] IT. OKAY. TWO POINT FOR OUR DISCUSSION CONSIDERATION, ACTION ON A SUPPLEMENT FOR RETIREES. HEALTH INSURANCE COVERAGE OF $200 A MONTH TO BE PAID FOR BY SAN PATRICIO COUNTY. OUR FORMER TREASURER BROUGHT THIS UP TO ME. I THINK WE'VE HAD IT BEFORE. A COUPLE OF TIMES IN THE PAST ABOUT, YOU KNOW, GIVING A $200 REDUCTION TO OUR RETIREES, YOU KNOW, TO HELP THEM SUPPLEMENT THEIR INSURANCE COSTS. MR. WENDELL, I THINK YOU HAD I DIDN'T BRING ALL THOSE PRINTOUTS, BUT I THINK WE HAD A NUMBER THERE. I THINK FOR THE $200, WASN'T IT GOING TO COST THE COUNTY LIKE 36,000 AND SOMETHING I THINK, OR IT MAY BE ON THE IT MAY BE ON YOUR AGENDA HERE. RIGHT. IT'S ON THE AGENDA. IT WOULD IT WOULD BE SOMETHING LESS THAN THAT. JUDGE. IT LOOKS LIKE WE CURRENTLY HAVE 12 RETIREES THAT ARE STILL ON THE COUNTY INSURANCE AT $2,400 PER YEAR. THAT WOULD BE 24. ABOUT $27,000 IS THE IMMEDIATE COST. YEAH. WHAT THE COST? THAT WE CAN'T CALCULATE. AND THAT WOULD REQUIRE AN ACTUARY TO BE ABLE TO CALCULATE IS THE ADDITIONAL COST TO THE PLAN. AND IN IN OTHER WORDS, IF THIS INCENTIVIZES OTHER RETIREES TO STAY ON THE PLAN, THERE WOULD THERE WOULD BE SOME POTENTIAL LIABILITY IN THA. TYPICALLY RETIREE MEDICAL COST IS MORE THAN WHAT THE PREMIUM THEY'RE THEY'RE PAYING IS. SO YOU WOULD YOU WOULD PROBABLY INCUR SOME SORT OF LIABILITY. AND THAT IS SOMETHING THAT UNFORTUNATELY I CANNOT CALCULATE FOR. YOU WOULD REQUIRE A, AN ACTUARY TO BE ABLE TO CALCULATE THAT. WELL, THE EXAMPLE ON THE ATTACHMENT, THE EXAMPLE GAVE 15 RETIREES TIMES $200, $3,000 PER MONTH WOULD BE $36,000 A YEAR IN ADDITIONAL EXPENDITURES FOR 15. IF THERE WERE 20, IT'D BE $48,000 PER YEAR. SO THERE'S A [01:00:03] FORMULA THERE. SO IT ALSO SAYS THAT THERE ARE 90 EMPLOYEES ELIGIBLE FOR RETIREE INSURANCE AS OF TEN 124. SO DOES THAT MEAN THAT THERE'S 90 THAT THIS WOULD THAT. WELL, YES, THAT MEANS THAT THERE ARE THERE ARE THERE ARE 90. AND IN OTHER WORDS, IF ALL OF THOSE RETIRE AND STAY ON YOU WOULD BE AT 100 AND 102 BECAUSE OF BECAUSE OF SOME CHANGES IN REPORTING REQUIREMENTS. I THINK IT WAS BACK IN, GOSH, I DON'T REMEMBER GASB 45, HOWEVER FAR BACK THAT GOES REQUIRED US TO START CALCULATING THIS. IN OTHER WORDS, HIRE AN ACTUARY, CALCULATE THE LIABILITY, AND START PUTTING IT ON OUR BOOKS. THERE'S BEEN A SUBSEQUENT SUBSEQUENT STATEMENT, GASB 75, WHICH HAS CHANGED THE WAY WE DO IT, BUT WE STILL HAVE TO REPORT THAT LIABILITY IF YOU USE WHAT IS CALLED A BLENDED RATE, WHICH THIS IS A BLENDED RATE, IN OTHER WORDS, IT'S A IT'S NOT AN ACTUARIALLY DETERMINED RATE. SO THEREFORE YOU HAVE TO HIRE AN ACTUARY, CALCULATE THE LIABILITY AND PUT IT ON YOUR FINANCIAL STATEMENTS. I WAS LAST WEEK, I WAS TRYING TO FIND THE INITIAL REPORT BECAUSE MY RECOLLECTION WAS THAT WHEN WE FIRST STARTED DOING THIS, THE ESTIMATE WAS THAT THE LIABILITY WOULD BE IN EXCESS OF $10 MILLION. AND THAT'S WHY BACK IN 2011, COMMISSIONERS COURT TOOK ACTION TO NO LONGER ALLOW RETIRED RETIREES TO STAY ON THE INSURANCE PLAN. IF YOU STARTED JANUARY 1ST, 2012, OR AFTER, THAT'S WHY YOU YOU SEE THAT NUMBER 90. THERE'S ONLY 90 EMPLOYEES WHO STARTED BEFORE THAT DATE THAT WOULD BE ELIGIBLE. IN OTHER WORDS, THEY WERE GRANDFATHERED. HOWEVER, I WILL SAY THIS, THAT THEY'RE IT'S MY UNDERSTANDING THAT THERE IS A STATUTE THAT A CERTAIN POPULATION AND I'M NOT EXACTLY SURE WHAT THAT IS, BUT I THINK IT'S ABOUT 70 OR 75,000 THAT COUNTIES ARE REQUIRED TO ALLOW EMPLOYEES TO STAY ON THE INSURANCE PLAN. SO AT SOME POINT YOU MAY BE BACK FACING THAT ISSUE OF HAVING A LARGE LOOMING LIABILITY ON YOUR FINANCIAL STATEMENTS. SO, YOU KNOW, THE INITIAL COST IS. $2,400 PER YEAR PER RETIREE. THAT'S THAT'S THE INITIAL COST. THE COST THAT THA, THAT I DON'T HAVE IN FRONT OF ME. BUT I COULD PROVIDE TO YOU IS AN ESTIMATE OF WHAT THE EXPENDITURES OF THE EMPLOYEE, I MEAN THE RETIREES VERSUS THE CONTRIBUTIONS THEY MAKE TO THE PLAN. I CAN TELL YOU, AS A GROUP, RETIREES COST THE PLAN MORE THAN WHAT THEY WHAT THEY PAY IN, AND HENCE THAT'S WHERE THE LIABILITY COMES FROM. DAVID DOES DOES THE PLAN COVER THEIR PRESCRIPTION DRUGS AS WELL? YES. THEY BASICALLY RECEIVE PRETTY MUCH THE SAME COVERAGE AS EMPLOYEES, ALTHOUGH IF THEY IF THEY'RE OVER 65, THERE WOULD BE SOME DIFFERENCES BECAUSE OF MEDICARE. AND NORMA COULD PROBABLY EXPLAIN THAT TO YOU. I'M NOT REALLY VERSED ON THAT PART OF IT. BUT WE KNOW WHAT'S HAPPENING WITH PRESCRIPTION DRUGS TODAY, RIGHT? YEAH, THAT'S THAT'S ONE OF THE ISSUES WITH OUR PLAN THAT WE'RE GRAPPLING WITH THIS YEAR AND TRYING TO TRYING TO COME UP WITH A SOLUTION FOR THAT. AND THAT IS OUR PRESCRIPTION COSTS ARE UP 65% THIS YEAR ALONE. SO IF I USE THE 90 EMPLOYEES WHO ARE ELIGIBLE AND I USE THE SAME FORMULA DOWN BELOW IN THE EXAMPLES, I WOULD GET 90 TIMES 200, WHICH IS 18,000 A MONTH, WHICH COMES OUT TO 216,000 FOR THE YEAR. SO THAT'S SUBSTANTIALLY MORE THAN WHAT WE WERE JUST TALKING ABOUT. BUT I THINK WHAT I NEED TO HAVE A HANDLE ON IS SOME OF THE OTHER ISSUES YOU JUST BROUGHT UP. SO AT WHAT POINT DOES THE POPULATION COME INTO PLAY? BECAUSE OUR COUNTY TECHNICALLY IS ABOVE 70,000 RIGHT NOW, SO WE PROBABLY NEED TO HAVE AN UNDERSTANDING OF THAT. YES. THE LAW IS THAT IT GOES ACCORDING TO THE LAST CENSUS. AND SO AT THE LAST CENSUS WE'RE UNDER 75,000. SO THAT LAW THAT MR. WENDELL ACTUALLY SENT TO ME, IT DOES NOT APPLY TO OUR COUNTY. WE'LL APPLY IN 2030. THEN, ASSUMING THE CENSUS SHOWS WE'RE ABOVE 75,000. YES, SIR. IT'S 75 OR 70. 75. OKAY. AND THERE'S ANOTHER STEP FOR, I THINK ABOVE 110,000. OKA. [01:05:12] WHAT'S THE COURT'S PRIVILEGE HERE? WHAT DO WE WANT TO DO? I THINK I WOULD LIKE TO HAVE A LITTLE MORE INFORMATION, JUST SO I HAVE A FULL UNDERSTANDING. WHAT WHAT THE LIABILITY TO THE COUNTY IS. JUST BEFORE WE MOVE FORWARD, I WANT TO MAKE SURE I FULLY UNDERSTAND WHAT WE'RE DOING. I UNDERSTAND THE CONCEPT. I UNDERSTAND, YOU KNOW, RETIREE, WE'RE TRYING TO DO SOMETHING TO HELP LESSEN THEIR BURDEN ON THEIR ON THEIR MEDICAL EXPENSES. I UNDERSTAND THAT PART. I JUST NEED TO FULLY UNDERSTAND HOW THAT IMPACTS THE COUNTY. YEAH, I AGREE WITH COMMISSIONER YARDLEY. SO I'LL MAKE A MOTION TO TABLE. SECOND, I GOT A MOTION BY GILLESPIE, SECONDED BY WILKINSON, TO TABLE. ALL THOSE IN FAVOR OF THAT MOTION SAY AYE. AYE. OPPOSED. SAME SIGN. WELL, MAYBE BETWEEN MR. WENDELL AND AIR. MAYBE YOU GUYS CAN KIND OF WORK TOGETHER AND COME BACK WITH SOMETHING FOR US THAT HELPS US BETTER UNDERSTAND THIS. YEAH. I'VE BEEN I SPENT YESTERDAY TRYING TO RESEARCH SOME OF THE OLD REPORTS THAT WE HAD HAVE NOT BEEN ABLE TO LOCATE THEM, BUT I HAVE REACHED OUT TO THE ACTUARY TO SEE IF I CAN, IF THEY STILL HAVE COPIES OF SOME OF THE OLDER REPORTS THAT WE CAN LOOK AT. SO WE NOT ONLY SEE WHAT WE HAVE NO, WHICH OFF THE TOP OF MY HEAD, THE LIABILITIES PROBABLY SOMETHING LESS THAN 2 MILLION. BUT OBVIOUSLY IF YOU OPEN THAT UP FROM IF YOU'RE REQUIRED TO OPEN THAT UP TO FROM 12 TO 102, THAT'S GOING TO DRASTICALLY INCREASE IT. AND THEN IF OBVIOUSLY IF WE HIT 75,000 IN 2030 AND WE HAVE TO OPEN IT UP TO HUNDREDS MORE, YOUR LIABILITY COULD CLIMB EASILY TO TEN, $20 MILLION. SO BUT I'LL SEE WHAT I CAN FIND IN THE WAY OF REPORTS THIS WEEK AND PROVIDE THAT INFORMATION TO YOU. OKAY. THANK YOU. SOUNDS GOOD. OKAY. THE NEXT FIVE OF THEM ARE GOING TO PERTAIN TO OUR PLAN FOR CURRENT [j. Discussion, consideration and action on increasing the Section 125 Unreimbursed Medical Expense from $3,200 to $3,300 for calendar year 2025.] EMPLOYEES. 2.4 J DISCUSSION, CONSIDERATION, ACTION ON INCREASE IN THE SECTION 125 UNREIMBURSED MEDICAL EXPENSES FROM 3200 TO 3000 3300 FOR THE CALENDAR YEAR 2025. I MAKE A MOTION TO APPROVE. I GOT A MOTION BY LOPEZ. I HAVE A SECOND, SECOND, SECOND BY WILKERSON. ANYTHING TO SAY? NO. ON THAT ONE. ON THIS ONE RIGHT NOW, WE CURRENTLY ARE AT 3200. WE'RE AWAITING APPROVAL FROM BRIE TO CONFIRM IRS NEW GUIDELINE, BUT THEY ARE CONFIDENT IT IS GOING TO BE AT 3300. WE'RE PREPARING FOR OPEN ENROLLMENT. IF ANYTHING DOES CHANGE, THEN OF COURSE I'LL BRING IT BACK TO THE COURT. BUT I'M GOING TO UTILIZE THAT 3300 IF APPROVED. RIGHT. OKAY. AND WHAT SETS THAT AMOUNT? SECTION 125 IS THE UNREIMBURSED CREDIT CARD EMPLOYEES USE FOR MEDICAL, DENTAL. IT'S A TAX FREE SAVINGS TO THE EMPLOYEES THAT THE MOVEMENT FROM 3200 TO 3300 IS SOLELY OUR DISCRETION. OR IS THAT DRIVEN BY SOMETHING ELSE? NO. WELL, WE FOLLOW IRS GUIDELINES, BUT THEY GIVE US A TARGET AMOUNT, AND THEN THE COURT JUST MAKES A DECISION HOW MUCH WE WANT TO GO WITH. OKAY. GOT A MOTION. SECOND, ANY OTHER DISCUSSION HEARING NONE. ALL THOSE IN FAVOR OF THE MOTION SAY AYE. AYE. THOSE OPPOSED? SAME [k. Discussion, consideration and action on dropping Plan B from the San Patricio County Health and Welfare Insurance plan for San Patricio County employees/dependents effective January 1, 2025.] SIGN. MOTION CARRIES 2.4 K. DISCUSSION, CONSIDERATION AND ACTION ON DROPPING PLAN B ON THE SAN FRANCISCO COUNTY HEALTH AND WELFARE INSURANCE PLAN FOR SAN FRANCISCO COUNTY EMPLOYEES SLASH DEPENDENTS, EFFECTIVE JANUARY 1ST, 2025. CURRENTLY, OUR INSURANCE PLAN HAS TWO. WE HAVE THE PLAN A, WHICH IS OUR FULL COVERAGE PLAN. MEDICAL HOSPITALIZATIONS. WE OFFERED A PLAN B SEVERAL YEARS BACK JUST TO KIND OF HAVE A PLAN FOR EMPLOYEES THAT DIDN'T REALLY HAVE TO UTILIZE IT. THEY HAD SECONDARY INSURANCE. WE ARE LOOKING AT OUR PLAN ITSELF, AND WE ONLY HAVE THREE EMPLOYEES THAT ARE ACTUALLY UTILIZING IT. ON PLAN B, YOU HAVE FIVE DOCTOR VISITS, YOU HAVE FIVE PRESCRIPTIONS. AND THAT'S PRETTY MUCH IT. THERE'S NO HOSPITALIZATION. WE'RE JUST TRYING TO REVAMP OUR PLAN TO KIND OF HAVE THAT CLARITY AND JUST HAVE A PLAN A FOR EVERYONE. MOVE TO APPROVE. SECOND, OUR MOTION BY WILKERSON. SECONDED BY GILLESPIE FOR APPROVAL. ANY OTHER QUESTIONS? HEARING NONE. ALL THOSE IN FAVOR OF THE MOTION SAY AYE. AYE. THOSE OPPOSED? SAME SIGN. MOTION CARRIES 2.4 L. DISCUSSION, CONSIDERATION AND [l. Discussion, consideration and action on moving the Vision Plan coverage from the Core portion of the San Patricio County Health and Welfare Plan back to ancillary policies effective January 1, 2025. ] ACTION ON MOVING THE VISION PLAN COVERAGE FROM THE CORE PORTION OF THE SAN PATRICIO COUNTY HEALTH AND WELFARE PLAN BACK TO THE AUXILIARY POLICIES EFFECTIVE JANUARY 1ST, 2025. THIS PAST YEAR, WE WENT AHEAD AND MOVED THE CORE, WHICH IS THE MEDICAL, DENTAL AND LIFE. WE MOVED THE [01:10:07] VISION PLAN INTO THAT SO WE COULD KIND OF PICK UP ALL NEW EMPLOYEES THAT WANTED THE VISION PLAN. WE WENT INTO A HICCUP WITH THAT WHEN WE REALIZED THAT THE ANCILLARY POLICIES ALSO HAVE COMPENSATION. SO THERE IS A COMMISSION ON THAT. IF YOU HAVE IT IN A CORE, IT MAKES IT A LITTLE AWKWARD BECAUSE OUR OFFICE IS THE ONE THAT HANDLES THE CORE PRODUCT, AND WE DO NOT DO COMMISSIONS, SO WE WANT TO JUST MOVE IT BACK INTO THE REGULAR ANCILLARY SO THAT AGENT CAN GET THEIR COMMISSION. AND IT DOESN'T INTERFERE WITH OURS. I MOVE TO APPROVE. SECOND, I GOT A MOTION BY GILLESPIE, SECOND BY LOPEZ. ANY OTHER DISCUSSION QUESTION. SO THE ONLY WAY YOU CAN PICK IT UP IS THROUGH THE OUTSIDE AGENTS. YES. WHEN WE DO OUR OPEN ENROLLMENT. ALL THOSE IN FAVOR OF THE MOTION SAY AYE. AYE. THOSE OPPOSED SAME SIGN. MOTION CARRIES 2.4 M DISCUSSION, [m. Discussion, consideration and action on renewing the Asserta Concierge Service Contract for 2025. ] CONSIDERATION AND ACTION ON RENEWAL OF CERTAIN CONCIERGE SERVICE CONTRACT FOR 2025. WE'VE HAD A SORT OF SINCE 2018. THIS IS THE FIRST TIME THEY HAVE COME TO US FOR ANY TYPE OF INCREASE IN THEIR RATES. OUR CASE FEES, WHICH IF YOU SEE EVERY MONDAY WE'RE HAVING FROM 1 TO 8, DEPENDING ON HOW MANY YOU SEE THROUGH MEDICASH, THAT ASSERTIVE IS ACTUALLY COMPENSATION. COMPENSATION REDUCTION ON OUR PLAN. THEY HAVE REALLY BEEN DILIGENT. WE HAVE A VERY GOOD CONTRACT WITH CHRISTUS SPOHN. THEY KNOW US ON A REGULAR BASIS, AND ACERTA HAS BEEN THE ONE THAT HAS ACTUALLY DONE THAT FOR US. OUR CURRENT PROCESS THAT WE HAVE RIGHT NOW IS MAINLY THE CONCIERGE SERVICES. IT'S CURRENTLY 250. THEY'RE WANTING TO GO TO 325, AND IT'S BASED ON THE ACTUAL PRICE OF THE PROCEDURE. SO IT'S JUST ABOUT A 25% INCREASE. BUT LIKE I SAID, WE HAVEN'T HAD AN INCREASE SINCE 2018 WITH THE SERVICE SINCE WE FIRST SIGNED UP WITH THEM. THE OTHER THING WE DID LOOK ON THEIRS IS WE'RE DOING OUR MONTHLY PER EMPLOYEE, PER MONTH, AND WE ARE JUST LOOKING AT A DOLLAR INCREASE PER PERSON. MOVE TO APPROVE. SECOND, AND A MOTION BY GILLESPIE SECONDED BY LOPEZ FOR APPROVAL. ANY QUESTIONS? ALL THOSE IN FAVOR OF THE MOTION SAY [n. Consideration and action on approving 2025 Medical, Dental, Life insurance rates for San Patricio County employees, dependents, outside entities, retirees and Cobra.] AYE. AYE. THOSE OPPOSED SAME SIGN. A MOTION CARRIES 2.4 IN CONSIDERATION AND ACTION ON APPROVING THE 2025 MEDICAL DENTAL LIFE INSURANCE RATES FOR SAN PATRICIO COUNTY EMPLOYEES, DEPENDENTS OUTSIDE ENTITIES, RETIREES AND COBRA. I'VE ATTACHED THE RATES FOR 2025. NOW I WILL SAY THAT I DO HAVE THE RETIREE RATES INCORPORATED IN THIS. ALSO, BECAUSE WE ARE STARTING TO SEND THOSE NOTICES OUT IF THE COURT LATER ON DECIDES TO MAKE A CHANGE, WE WILL GO AHEAD AND LET THE RETIREES KNOW IF THERE IS A CHANGE IN THAT MONTHLY RATE. I WILL TELL YOU THAT WE HAVE NOT HAD AN INCREASE. WE I WENT BACK THE LAST INCREASE WE HAD WAS IN 20. WE ACTUALLY HAVE BEEN AT A DECREASE. 2021 WAS THE LAST TIME WE HAD A RATE INCREASE FOR EMPLOYEE ONLY AND DEPENDENT COVERAGE. WE HAVE BEEN FLAT FOR THE LAST THREE YEARS, AS MR. WENDELL HAS CLEARLY STATED, OUR PRESCRIPTION HAS BEEN KIND OF OUTRAGEOUS. THIS YEAR. WE HAVE SEEN A HUGE INCREASE IN IN WHAT PHARMACEUTICAL IS COSTING US GOING INTO NEXT YEAR AND BRINGING IN OUR NEW CONSULTANT. WE ARE LOOKING AT MAKING SOME CHANGES AND TRYING TO FIND SOME DIFFERENT AVENUES. BUT I WILL TELL YOU, THE MAIN REASON FOR THE INCREASE THAT WE ARE GOING TO HAVE TO SHOW THIS YEAR IS DUE TO THE PHARMACEUTICAL, OUR PRESCRIPTION. PART OF IT IS WHAT'S KIND OF MAKING THAT RISE. MEDICAL IS PRETTY GOOD BECAUSE WE DO HAVE ASSERTED THAT HAS HELPED US ON THAT PART. THANK GOODNESS. BUT THE PHARMACEUTICAL IS WHAT KIND OF HIT US IN. MR. WENDELL AND I WERE WORKING ON THE NUMBERS, AND WE KIND OF LOOKED AT ABOUT 12.66. SO WE'RE LOOKING AT A 13% INCREASE. IF YOU LOOK AT LAST YEAR TO THIS YEAR, IT'S ABOUT A DOLLAR INCREASE FOR EMPLOYEE A MONTH. SO THAT'S NOT TOO BIG OF AN INCREASE DEPENDING COVERAGE IS WHERE YOU'LL KIND OF SEE IT A BIT, WHERE YOU'RE GOING TO BE GOING FROM EMPLOYEE AND SPOUSE. YOU'RE GOING TO GO TO. CURRENTLY, WE'RE AT $282. AND WE'LL BE GOING TO 319. SO ON THE AGENDA, I TRIED TO LOOK AT THESE RATES, BUT SOMEHOW IT SENDS ME TO AGENDA QUICK AND DOESN'T LET ME SEE THE RATES. OKAY. IT WAS AN ATTACHMENT. I DON'T THINK THE ATTACHMENT TOOK. OH, IT DIDN'T OKAY. YEAH THAT'S WHAT I GOT RIGHT THERE. YEAH. SO I WOULD KIND OF LIKE TO SEE ALL THESE RATES BECAUSE WE'RE TALKING ABOUT SEVERAL DIFFERENT THINGS HERE. I KIND OF LIKE TO BE ABLE TO SEE ALL THIS BEFORE I VOTE ON THIS. I HAVE TO AGREE WITH THAT TOO. I HAVE THEM HERE FOR COPIES, OR WE CAN PUT THEM ON FOR NEXT. I WON'T BE HERE NEXT WEEK. WELL, YEAH, I'D LIKE TO TABLE THIS SO WE HAVE TIME TO LOOK AT THIS. YOU CAN SEND IT OUT TO US. OKAY. THE 25 PROPOSED [01:15:01] RATES ARE THERE. IF YOU CLICK ON THE LINK, THAT IS THE SUBJECT TITLE. THAT'S THE ONE THAT TAKES YOU BACK TO YOUR LAST MOTION ON THE FLOOR. THEN HAVE A SECOND YET HAVE A SECOND SECOND. ALL RIGHT. SECOND. SORRY, MR. WENDELL. OKAY. THE INFORMATION I JUST WANTED TO LET YOU KNOW THE INFORMATION IS THERE. THERE IS A THERE IS A LINK THAT WILL SHOW THE 25 RATES. IF YOU CLICK THE LINK, THAT IS THE SUBJECT THAT WILL TAKE YOU BACK TO THE 24 RATES. THAT'S THE CONFUSION. AT LEAST THAT'S THE WAY IT'S WORKING ON MY IPAD. OKAY, GOT A MOTION IN A SECOND TO TABLE ALL IN FAVOR OF THAT MOTION SAY AYE. AYE. THOSE OPPOSED SAME SIGN I FOUR YEAS AND ONE NAY. NAY. WHO SAID NAY I DID OKAY. OKAY. HAVE TRIED TO REATTACH IT AND I'LL GO AHEAD AND EMAIL IT TO ALL OF Y'ALL. THANK YOU. THAT'D BE BEST. THANK YOU. EMAIL IT FIRST AND THEN WE'LL ATTACH IT FOR NEXT WEEK AS WELL. THANK YOU MA'AM. OKAY. CONCLUDES THE INDIVIDUAL ACTION ITEMS. WE'LL [3.
